Doctrine of Continuous Transit
MS 9287.06 · Practices and doctrines
The Doctrine of Continuous Transit constitutes the fundamental legal and operational principle governing all movement of entities, objects, and information through the circulatory systems of the Tower, most notably within the Great Vertical Spiral. It asserts that any transit event, once initiated, is a singular, indivisible ontological state that persists until formal arrival is documented.
Principle and Definition
As codified in Annex VII, Clause 12 of the Annals of Jurisprudence, the Doctrine states: "A state of transit, once properly manifested and entered into, shall be considered a continuous condition. It is not a sequence of moments but a unified whole, bounded only by the authorized points of departure and arrival." In practical terms, this means that an entity travelling from Floor Δ-7 to Atrium 44-B via a recognized transit aperture exists, for the duration of the journey, in a condition of "procedural transit." This condition carries specific legal implications, primarily its interaction with the Doctrine of Continuous Custody.
Interplay with Continuous Custody
The Doctrine of Continuous Transit is the necessary corollary to the Doctrine of Continuous Custody. Custody requires an unbroken chain of documented possession. The Transit Doctrine provides the legal fiction that bridges custodial gaps during physical movement. When an object is transferred from one certified custodian to another via the Spiral, the object is considered to remain under a form of "procedural custody" for the journey's duration. This is maintained by the accompanying Transit Manifest, which serves as the instrument of continuous custody. Thus, the object is never legally "unattended," even when physically alone in a transit conduit, preventing any lapse that might invite ontological decay or proprietary challenges.
Operational Implementation
Implementation falls to the Transit Gendarmerie and the clerks of the Bureau of Ambiguous Transit. A journey must be initiated with a validated Manifest. The act of passing through a departure aperture seals the state of continuous transit. Intermediate stops, even for procedural checks, do not constitute a break, provided the Manifest remains with the convoy and is annotated by Gendarmerie officials at checkpoints. The state only terminates when the convoy passes through the designated arrival aperture and a Form L-29 "Manifest of Arrival" is filed, creating the definitive endpoint for the continuous event.
Disputes and Ambiguities
The principle is not without its controversies. The primary scholarly dispute concerns the definition of "initiation." The Strict Constructionist school, citing the Annex Omega Document, argues that transit begins only when the lead element of a convoy physically crosses the threshold of a sanctioned aperture. The Preparatory school, however, holds that the state begins upon the final validation of the Manifest by a Gendarmerie officer, which may occur several meters from the actual aperture. This disagreement has led to numerous adjudications before the Office of Epistemic Transit, particularly in cases where an incident occurs after validation but before threshold crossing.
A further ambiguity involves "stasis fields" or maintenance holds within the Spiral. Concordance 88-E explicitly states that scheduled halts for spiral equilibrium recalibration do not violate continuity. However, Concordance 102-G contradicts this, asserting that any cessation of forward momentum for a period exceeding seven standard Tower cycles constitutes an "arrest" of transit, requiring a new Manifest. Most operational authorities pragmatically follow 88-E, but the contradiction remains a fertile ground for legal challenge.
Consequences of Breach
A breach of Continuous Transit—such as an unauthorized exit, a lost Manifest, or the application of the contested Concordance 102-G—results in a "transit fracture." The entity in movement is considered to have entered a state of provisional transit, a legally precarious condition. Its ontological standing becomes ambiguous, and its custody chain is considered broken. Remediation requires a full audit by the Bureau of Ambiguous Transit and often a petition for custodial reinstatement under the Doctrine of Continuous Custody. In severe cases, objects have been impounded in the Sentinel Void pending resolution.
Relation to Other Doctrines
The Doctrine of Continuous Transit is a foundational support for the Tower's entire logistical and ontological framework. It enables the Doctrine of Perpetual Becoming by ensuring that entities in motion are legally "continuous" and thus eligible for refinement. It is philosophically contrasted with, though operationally aligned with, the Doctrine of Continuous Approximation, which governs representational rather than physical movement. Together, these doctrines create a universe of unbroken lines—of custody, of travel, of existence—upon which the archival stability of the Tower depends.
