Provisional Authority Transfer

MS 3610.49 · Practices and doctrines

Provisional Authority Transfer (colloquially, Transfer-in-Absentia) refers to the temporary delegation of administrative, procedural, or custodial authority within the Tower's hierarchy, enacted when a designated post is vacant or its occupant is unable to discharge their duties. The practice is governed primarily by Annex 7 of the Third Concordance, with supplementary provisions scattered across thirteen subsequent Concordances, resulting in a system noted for its labyrinthine complexity and frequent internal contradictions.

Transfer is not a singular act but a cascading sequence of validated instruments, beginning with a Declaration of Incapacity or Notice of Vacancy, proceeding through an Interim Mandate, and culminating in the issuance of a Certificate of Assumed Function. The entire process must be logged within the Provisional Protocol Summaries before any transferred authority can be exercised lawfully.

Triggers and Declarations

A Provisional Authority Transfer may be triggered by several conditions, as enumerated in Concordance 3, Annex 7, Clause ii:

  1. The confirmed death, disappearance, or indefinite incapacitation of a post-holder.
  2. A scribe's voluntary invocation of Sabbatical-Lapse Protocol.
  3. The unilateral declaration by the Synod of Precise Meaning that a post has "entered a state of procedural dissonance."
  4. The physical inaccessibility of a post's designated chamber for a period exceeding forty-seven Tower-days, as certified by a Stone-Warden.

Upon a trigger event, the Bureau of Appointments must file a Notice of Vacancy with the Central Registry. Scholarly debate persists regarding whether a trigger is self-executing or requires ratification by the Receiving Authority; the Eleventh Concordance suggests the former, while precedent set during the Schism of the Silent Inkwell leans toward the latter.

The Interim Mandate

Between the declaration and the full transfer, authority resides in an Interim Mandate. This document does not confer the full powers of the original office but permits the designate to "maintain essential functions and prevent systemic collapse." The scope of "essential functions" is notoriously ill-defined. During the provisional authority transfer following the disappearance of the Architect-Superior, Deputy Curator Vael, acting under an Interim Mandate, authorized the reclassification of seven entire sub-floors, an action later contested by the Progressive Indexers' Collective as gross overreach.

The Mandate is typically held by the deputy or next-most-senior official within the same department. In cases where no clear deputy exists, authority devolves to the geographically nearest official of sufficient grade, as mapped by the Pneumatic Routing Tables. This has, on occasion, resulted in a Warden from Transfer Floor 19-Kappa temporarily overseeing operations in the Vestibule of Unspoken Prefaces, creating significant logistical confusion.

Certification and Assumption

Full transfer is effected by the Certificate of Final Form, which, as per the Third Concordance, serves the dual purpose of attesting to the formal revision of all relevant protocols and transferring custodial authority. The Certificate must bear the seals of the Bureau of Registry, the Office of Procedural Reconciliation (located on Transfer Floor 8,441), and the outgoing authority (or a proxy validated by the Synod of Precise Meaning).

The assumption of authority is not considered complete until the designate has undergone Contextual Spooling for the new post and their appointment is entered into the Master Roll held in the Central Registry. This final step is often delayed for months, leading to the peculiar state where an individual exercises full authority provisionally while remaining officially listed as their previous, lesser rank.

Controversies and Limitations

The system is fraught with points of conflict. A major tension exists between the need for swift action and the requirement for exhaustive documentation. The Provisional Stone-Wardens Committee famously operated for eleven years under a Provisional Authority Transfer due to a filing error in the Provisional Protocol Summaries on Floor 412.

Furthermore, certain powers are explicitly non-transferable. These include the authority to issue a Provisional Research Permit, to alter the numbering sequence of a floor, or to decommission a Provisional Aperture. Attempts to exercise such powers under a transfer are considered void ab initio, and all actions taken under the mistaken authority must be unwound, a process detailed in the contentious Provisional Protocol 888-A.

Termination

A transfer terminates upon one of three events: the return of the original authority-holder, the permanent appointment of a new holder to the post, or the expiration of the transfer term (set at 990 Tower-days, unless extended by a three-quarters vote of the relevant bureau). Termination requires the execution of a Deed of Reversion, which systematically rescinds the Interim Mandate and Certificate of Assumed Function, and triggers a full audit of all actions taken during the provisional period. The findings of this audit are filed, invariably, with the Provisional Protocol Summaries, ensuring the cycle of provisional documentation perpetuates itself.
