Declaration of Incorporeal Donation

MS 1138.46 · Practices and doctrines

The Declaration of Incorporeal Donation is a formal instrument by which a donor may provisionally transfer the rights and privileges of a non-material, typically conceptual, property to a designated donee within the Tower’s legal continuum. Governed by the Third Concordance, Annex γ, and subject to the Clean Page Doctrine, the Declaration establishes a fiduciary nexus without necessitating the physical or even verified existence of the donated property at the time of filing.

The process is initiated by submitting Form 22-D, "Notice of Intent for Ideational Transfer," to the Halls of Equivocation. This must be accompanied by a notarized affidavit asserting the donor's "unencumbered conceptual ownership" of the property in question, a status often itself predicated on a prior Declaration of provisional existence. The core instrument, the Declaration of Incorporeal Donation, is then inscribed at the Station of Declaration, with the donee’s acceptance signature required to be filed concurrently at the Station of Citation to prevent a state of unilateral conceptual obligation.

Eligible Properties

Per Resolution 1, properties suitable for incorporeal donation are explicitly non-material. Canonical examples include, but are not limited to:

  • The future goodwill of an enterprise not yet founded.
  • The melancholic ambiance of a specific, unoccupied corridor.
  • A "right of first refusal" on a philosophical position still under formulation.
  • The resonant quality of a silence that has not yet occurred (see Declaration 88-C for related prohibitions on verifying anticipated states).
  • The copyright to a dream, provided the dreamer has filed a Voluntary Declaration of its contours.

Tangible assets, debts, or physically instantiated memories are expressly excluded and must be processed through the Halls of Unsettled Accounts under different protocols.

The Transfer and Fiduciary Nexus

Upon final seal affixation by a Clerk of the Seventh Rank, the Declaration creates a fiduciary nexus binding the donee. This nexus obligates the donee to act "in the best conceptual interest" of the donated property should it ever attain a state of verifiable existence. For instance, the donee of a donated "aura of mystery" would be required to defend its integrity against premature clarification. The donor relinquishes all claim to the property's emergent benefits, though they retain liability for any latent contradictions or Declarations of Strain attached to its core definition.

The nexus is monitored by the Office of Ephemeral Holdings, which may periodically issue inquiries (Form OVC-1a) to the donee regarding the property's conceptual maintenance.

Controversies and Scholarly Disagreement

A significant doctrinal rift exists regarding the donee's liability for properties that manifest in a harmful or procedurally anomalous form. The Fourth Concordance, Clause 17, implies the donee assumes all attendant risks, citing the principle of caveat recipient. However, a counter-reading of the Fifth Concordance's commentary on Procedural Declarations argues that a property which manifests as a Declaration of Procedural Anomaly is inherently void ab initio, negating the transfer and potentially refunding the initial filing fees to the donor. This contradiction remains unresolved, leading to complex arbitration in cases like In re: The Donated Precedent of Infallibility.

Furthermore, the act of donating a property defined by its own anticipated verification—such as "the satisfaction of resolving this paradox"—creates a logical recursion that may violate Declaration 88-C. Some jurists argue such donations are permissible under the broader umbrella of Negatory Declarations, while others hold they constitute a Declaration of Conceptual Null State and must be voided.

Revocation and Dissolution

A Declaration of Incorporeal Donation is perpetually binding unless dissolved by one of three mechanisms:

  1. Mutual Recission: Both parties filing a Joint Dissolution of Ephemeral Interest (Form J-7) before the property manifests.
  2. Conceptual Exhaustion: The property is formally declared to have reached a state of "irreducible banality" by a panel of three Conceptual Assessors, rendering the nexus moot.
  3. Donee's Declaration of Incapacity: The donee may file a Declaration of Incapacity if the fiduciary burden of maintaining the property's conceptual integrity becomes untenable, triggering a review for Provisional Authority Transfer.

All dissolution proceedings are archived in the Halls of Equivocation and contribute to the precedents governing future ideational transfers.
