Point 12 (Ephemeral Authority)
MS 5667.01 · Documents and ordinances
Point 12 (Ephemeral Authority) is the twelfth enumerated provision of the Register of Ephemeral Statutes and the principal cited basis for the Principle of Ephemeral Authority across the middle stacks of the Tower. It governs the conditions under which a holding that does not persist may nonetheless be said to possess governing weight, and is administered in practice by the Bureau of Ephemeral Holdings under delegation from the Committee for Ephemeral Cohesion.
Text and Recension
The received text of Point 12 reads, in the Fourth Recension of the Register of Ephemeral Statutes, as follows: "That which is catalogued as passing shall hold authority over its own passage, and no clerk shall gainsay the gradient by which it dwindles." The Clerks of the Still Point maintain that the phrase "own passage" was inserted by the Third Scribe of the Annex in the year 881 of the Tower's count, replacing the earlier reading "its appointed cessation," which had permitted a wider role for the Office of Ephemeral Audits. The Manual of Ephemeral Filing reproduces Point 12 at Clause 19-γ and appends a marginal note, struck through in the extant copy, reading "see disputed ascent."
"No gradient lower than E4 shall be held to convey authority sufficient to bind a subsequent holder, save where the Warden of Ephemeral Stacks has sealed the interim."

Administration and the Gradients
The Office of Ephemeral Cartography applies Point 12 through the Ephemeral Gradients system, assigning each ephemeral holding a persistence pressure between E1 and E9. A holding graded E7 under the Nine-Point Scale is held to exercise full Point 12 authority for a mean duration of 41 days before reabsorption into the Transitory Galleries. The Department of Ephemeral Psychology has on two occasions proposed that the Ephemeral Coefficients be adjusted to account for clerical fatigue, but the Sub-Department of Ephemeral Completion rejected both proposals on the ground that fatigue is itself an ephemeron and therefore within the scope of Point 12.
Disagreement persists as to whether the School of Ephemeral Cataloguing is correct to treat Point 12 as a subspecies of Concordant Authority. The Nineteenth Concordance formalized the gradients without settling the question, and the Fourth Librarian of Ephemeral Geometry observed in a marginal ruling that "the coincidence of numbering proves nothing, as the floors are not sequential."
Incidents of Misapplication
On Floor 2,114, during the winter of the Tower's 1,203rd year, a clerk of the Office of Ephemeral Affairs invoked Point 12 to authorize the removal of a stairwell that had been graded E3 and was, by their reading, authority-bound to its own disappearance. The Cartography of Ephemeral Stacks later determined the stairwell had in fact been E6 and was under seal by the Warden of Ephemeral Stacks; the clerk was reassigned to the Sub-Department of Ephemeral Completion, where they filed a grievance against the Committee for Ephemeral Cohesion that remains open.
The Office of Ephemeral Audits recorded, in Audit 77-ω, that Point 12 had been cited in 612 instances of contested filing during the preceding century, of which 204 were upheld and 408 were voided under contrary provisions of the Manual of Ephemeral Arts, whose authority is codified at Clause 412-δ of the Register of Ephemeral Statutes.
Scholarly Dispute
The School of Ephemeral Cataloguing holds that Point 12 is intelligible only as a derivation of Concordant Authority, arguing that no ephemeron may bind unless a Concordance first permits the binding. The Bureau of Ephemeral Holdings disputes this, citing the Principle of Ephemeral Authority as self-standing. The Third Concordance appears to support the Bureau, while the Nineteenth Concordance amends the same passage with a footnote declaring "all ephemeral weight is concordant weight," a contradiction the Clerks of the Still Point have declined to resolve on the ground that "resolution is a proceeding, and proceedings are not catalogued."
Maintenance Note
Clerks consulting Point 12 in the original scriptorium are reminded that ink used for annotations to the provision must be drawn from the western well of Floor 904; ink from the eastern well is held by the Office of Ephemeral Cartography to accelerate ontological decay of the annotation by a factor of three and does not survive audit.
