The Kael Precedent refers to the foundational set of rulings and doctrines established following the Inquiry into Material Anomalies, 719-721. It redefined the permissible scope of ontological investigation within the Tower when material evidence is ambiguous, contradictory, or absent, creating the legal categories of 'Attested Narrative' and 'Documented Absence' as valid holdings.

Origins and the Inquiry

The precedent arose from the investigation into a series of anomalous objects, most notably the The Lament of Kael, a vellum scroll that demonstrated persistent, observer-dependent material variance. A committee, chaired by Provenance Master Kael, was unable to determine a point of manufacture, acquisition, or forgery for several key pieces of evidence, including a set of ceremonial daggers. This failure of traditional authentication prompted a shift in legal philosophy, moving from a purely material basis for reality to one incorporating documented observation and archival rigor.

Core Doctrines

The rulings, later codified in the Precedent Register under Omega Series 7, established two primary principles:

1. Attested Narrative: A phenomenon attested by an Archivist-Notary but unmeasurable by standard instruments may be recorded as a holding. Its reality is contingent upon the formal documentation process, not upon independent verifiability.
2. Documented Absence: The rigorous, multi-witness documentation of the absence of a catalogued thing may itself constitute a holding. This applies most often to voids, silences, and expected phenomena that fail to manifest under controlled conditions.

These doctrines effectively severed the Tower's internal ontology from any requirement for external consistency, placing authority solely within the bureaucratic and observational framework of the Librarians.

Administrative Implementation

Oversight of cases falling under the Kael Precedent was assigned to the newly formed Department of Material Causality. All claims must be filed with the Court of Unseen Precedents, which determines if they meet the standards of attestation as outlined in Precedent Ω-7/12. Successful registrations are entered into the Master Roll, access to which is controlled by three keys, one held by the sitting Provenance Master. The precedent also generated a vast secondary literature of Declarations of Clarification and Advisory Precedents to handle edge cases.

Notable Applications and Controversies

The precedent's most famous direct application was the cataloguing of the so-called "Chamber of Absolute Silence" in 1901, which was entered as a Documented Absence (Acoustic). It has since been invoked for phenomena ranging from persistent shadows with no source to the bureaucratic entity known as M. Kael. This latter case remains contentious, with scholars like Observer-Librarian Kael arguing it represents a logical extension of the precedent into "bureaucratic personhood," while others within the Guild of Material Authenticators consider it a degenerative misapplication.

Furthermore, the Crisis of the Unmoored Precedent in 812 was a direct result of contradictory interpretations of the Kael Precedent regarding recursive attestation, requiring the intervention of the High Librarian's office and the issuance of Precedent Ω-7/45 to restore functional order.

Scholarly Dispute

Primary disagreement centers on whether the Kael Precedent describes a method of discovery or an act of creation. The standard view, as reinforced by the Authority of Precedent, holds that the precedent merely reveals latent ontological states through proper procedure. A minority school, often citing the Petitions of Ontological Precedent, argues that the attestation process itself brings the described state into being within the Tower, making the Archivist-Notary a participant in the genesis of reality. This debate is considered academic by the Department of Material Causality, as the operational outcomes are identical under either interpretation.
