Advisory Precedent

MS 4088.29 · Practices and doctrines

Advisory Precedent denotes a class of non-binding archival rulings issued by designated consultative bodies within the Tower to guide cataloguers in the processing of holdings whose ontological status or classificatory path is ambiguous. Unlike Binding Precedents, which carry the authority of the Court of Unseen Precedents, Advisory Precedents function as a procedural lubricant, offering recommended methodologies without establishing formal law. Their weight derives from their persuasive logic and their citation in the footnotes of subsequent binding rulings.

Origins and Juridical Foundation

The concept emerged during the protracted debates following the Precedent Ω-7/12, which, while establishing protocols for dual-domain indexing, left numerous procedural gaps. The Subcommittee for Orthographic Purity, in its advisory capacity, issued a series of recommended glyph-sequencing practices for non-linear narratives, which were later informally codified as the first Advisory Precedents. Their standing was formally acknowledged, though not empowered, in an addendum to Precedent Ω-7/45, which notes that "the consultative guidance of certified bodies may illuminate a path where the Concordances provide only shadow." This established the principle that Advisory Precedents exist in a liminal space between recommendation and regulation.

Issuing Bodies and Scope

Only guilds and committees chartered under the Concordances may issue Advisory Precedents. The most prolific issuers include the aforementioned Subcommittee for Orthographic Purity, the Society for Informed Ascent (for matters pertaining to vertical transit and inter-floor cataloguing coherence), and the Bureau of Implementable Abstraction. Their scope is explicitly procedural. An Advisory Precedent might detail a seven-step verification process for self-referential artefacts, propose a taxonomy for ephemera with decaying reality coefficients, or outline the proper form for cross-referencing a holding that disputes its own index number. They may never rule on the fundamental reality of a holding, as this is governed by the Principle of Catalogued Reality.

The Advisory Precedent Register

Advisory Precedents are recorded in a separate, voluminous annex to the main Precedent Register, known informally as the "Grey Ledger." Entries are tagged with an alpha-numeric code (e.g., A/SIA-44.7: "Handling of Upward-Propagating Narrative Echoes") and include the issuing body, date of issuance, a synopsis, and the full text of the recommendation. A critical field is the "Adoption Status," which tracks whether the advice has been cited in a binding ruling, ignored, or explicitly rejected. The Ledger is maintained by the Clerks of the Ephemeral, a sub-division of the Librarians tasked with monitoring the lifecycle of non-permanent rulings.

Impact and the Doctrine of Creeping Authority

While non-binding, a well-argued Advisory Precedent can exert significant influence. The Kael Precedent, for instance, drew heavily upon Advisory Precedent B/OAP-12 ("Documentary Protocols for Attested Absences") issued decades prior by the now-defunct Office of Absential Phenomena. This process, whereby advisory guidance gradually hardens into binding law through repeated judicial reliance, is known as the Doctrine of Creeping Authority. It is a subject of continuous scholarly debate. Traditionalists within the Court of Unseen Precedents argue it subverts the formal amendment process of the Concordances, while pragmatists contend it is an essential mechanism for the Tower's legal system to adapt to novel forms of unreality.

Notable Examples and Controversies

Advisory Precedent Γ/SIA-303, "Best Practices for the Cataloguing of Inadvertent Stairwells," remains a cornerstone of expeditions conducted under the auspices of the Society for Informed Ascent. Conversely, Advisory Precedent Δ/SP-9, which recommended the use of a specific vermilion ink for marginalia on unstable timelines, was famously rejected in the binding ruling Ω-7/45, which established the principle of Permissible Incompleteness instead. The greatest controversy surrounds Advisory Precedents that are silently ignored; a subset of legal theorists, following the Doctrine of Necessary Precedent, argue that a sufficiently old and un-contradicted Advisory Precedent should be considered de facto binding, a position the Librarians have repeatedly and firmly dismissed as "procedural animism."

Current Status

As of the last synchronization with the Central Chronometer, there are 14,887 active Advisory Precedents on record, with an average of 12.4 new issuances per annum. They remain the primary tool for specialist bodies to shape daily archival practice without engaging the cumbersome machinery of the Court of Unseen Precedents. Their proliferation is often cited as evidence of the Tower's bureaucratic vitality, while their inherent lack of final authority is seen as a necessary check against the over-rigid codification of processes dealing with fundamentally uncodifiable subjects.
