Precedent
MS 3718.47 · Practices and doctrines
Precedent is the foundational principle of governance and documentation within The Tower. Operationally defined as a ruling, judgment, or established practice that serves as an authoritative rule or example in subsequent similar cases, precedent forms the binding architecture of administrative law. Its authority derives from The Authority of Precedent, a practice commissioned under Precedent 22-, which vests interpretive and promulgative power in designated bodies including the Court of Unseen Precedents and the Precedent Register.
Classification and Hierarchy
Precedents are categorized by domain and jurisdictional weight. The primary classifications are Standing Precedents, which address ongoing administrative procedures, and Circulars of Precedent, which are issued to clarify or amend standing rulings. The issuance of a Circular of Precedent is the sole prerogative of the Court of Unseen Precedents, as per Precedent 22-. Precedents are further distinguished by their sphere of influence: ontological precedents govern questions of existence and cataloguing legitimacy; administrative precedents regulate inter-departmental conduct and resource allocation; and procedural precedents dictate the methods of amendment, appeal, and archival.
A complex hierarchy exists among precedents. While newer rulings typically hold greater force, this is superseded by the principle of Concordancial Supremacy, wherein any ruling explicitly cited within a numbered Concordance takes precedence over a non-cited ruling, regardless of chronology. This often creates the conditions for legal stalemates, such as the Crisis of the Unmoored Precedent.
Generation and Archival
The lifecycle of a precedent begins with a draft Pronouncement, submitted to the Precedent Register for review. If deemed necessary and non-contradictory within the current interpretive framework (a determination itself guided by precedent), it is elevated for ratification. Ratified precedents are assigned a dual designation: a serial number (e.g., Ω-7/12) and, for significant rulings, a colloquial name (e.g., The Precedent of the Silent Stair). All final documents are permanently archived within the Hall of Administrative Precedent on Floor 9,412 ("The Codices").
The physical archival process is prescribed by precedent. Each ruling is inscribed on a standardized parchment strip, treated with a suspension of dust from the Floor of Perpetual Filing, and sealed with the wax of the Bees of Official Record. The strip is then filed within one of the Hall’s millions of rotating drum catalogues, a system maintained under the Doctrine of Necessary Precedent.
Notable Precedential Conflicts
The interpretative nature of precedent guarantees conflict. A seminal example is the shift from Precedent Ω-7/12 to Precedent Ω-7/45. Precedent Ω-7/12 reinforced a restrictive physicalist interpretation of the Petitions of Ontological Precedent, effectively denying cataloguing status to entities without measurable spatial extension. This led to the Crisis of the Unmoored Precedent, a seventeen-year period during which entire wings of speculative taxonomy were left in administrative limbo. The crisis was resolved by Precedent Ω-7/45, which superseded Ω-7/12 by introducing the concept of "implied volumetric integrity," thereby allowing for the classification of nonspatial phenomena.
Another enduring conflict centers on the Kael Precedent versus the Advisory Precedent. The Kael Precedent holds that a ruling affecting a specific floor’s indexing schema must be physically present on that floor to be binding. The Advisory Precedent argues that the authority of the Court of Unseen Precedents is universal and not subject to geographical limitation. This has resulted in the phenomenon of "Jurisdictional Patches," where adjacent reading rooms on the same floor operate under mutually exclusive filing protocols.
Philosophical Interpretations
Scholars within the Tower are divided on the ontological status of precedent itself. The Physicalist School, championed by the Archivists of the Concrete Volute, argues that a precedent is only real insofar as it is materially instantiated on an archived parchment strip. Any discussion of its "meaning" or "spirit" is, to them, a metaphysical error.
Contrastingly, the Interpretivist School, based primarily on Floor 22,001 ("The Annotations"), maintains that the true precedent exists in the collective administrative consciousness—the archived document is merely a trigger for a memetic protocol. They cite the Precedent-Setter's Ruling, a document whose original parchment was lost in the Fire of Misplaced Inquiries, yet which continues to influence rulings like The Precedent of Recursive Jurisdiction through oral tradition and citational inertia. A minority Substitutionalist faction goes further, proposing that sufficiently oft-cited precedents generate their own physical documents through Bureaucratic Telos, rendering the original artifact irrelevant.
Precedent as a Cataloguing Principle
Beyond governance, precedent serves as a secondary indexing method within the Tower’s library functions. Known as "jurisdictional correlation," this system links catalogued subjects not by thematic content but by the legal precedents invoked during their accession. For instance, all specimens catalogued under the authority of Precedent Ω-7/45 are cross-referenced in a dedicated ledger, creating a de facto taxonomy of the provisionally real. This practice exemplifies the Tower’s core epistemological principle: that the framework of knowledge is inseparable from the rules governing its assertion.
