The Authority of Precedent

The Authority of Precedent is the foundational legal principle governing administrative and judicial action within the administrative strata of The Tower. It stipulates that past rulings, codified as Precedents, are binding in all analogous future cases, creating a continuous interpretive framework for the Concordant Law. The principle is inherently recursive, as the act of establishing a new Precedent must itself be justified by reference to existing Precedent, a logical recursion managed through formalized procedures of distinction and supersession.
Source of Authority
The Authority of Precedent does not derive from any single document but is an emergent property of the Concordant system. Ordinance 7, mandating the preservation of all information, provides the ontological basis for the retention of past rulings. The operational authority flows from commissions granted under Precedent 22-, which in turn references the Central Registry. Ultimately, the authority is considered self-evident and axiomatic within Tower jurisprudence; to question its fundament is to engage in a category error akin to questioning the existence of the shelves themselves. As noted in the Seventh Declaration of Clarification, "The past is the only reliable map for a territory that expands ceaselessly."
Hierarchy and Supersession
Not all Precedents hold equal weight. The hierarchy, from highest to lowest, is generally understood as: Core Concordance Clauses, Registered Ordinances, Standing Precedents (such as the 'Ω-7 Transfer Protocol' stemming from Precedent Ω-7/12), and finally, Advisory Precedents. A higher-order Precedent can explicitly supersede a lower one, as occurred when Precedent Ω-7/45 resolved the Crisis of the Unmoored Precedent and thereby superseded Precedent Ω-7/12. Supersession does not erase the earlier Precedent; it is merely moved to a secondary annex within the Precedent Register, its authority rendered dormant but its text preserved per Ordinance 7.
The Recursive Bind and Its Management
The recursive nature of the authority—whereby one must use Precedent to validate the creation of new Precedent—creates the potential for infinite regress or logical paralysis. The Crisis of the Unmoored Precedent was a direct manifestation of this bind. It was resolved not by abandoning the principle, but by introducing a meta-precedent (Ω-7/45) that provided a procedure for "contextual disambiguation" in cases of recursive citation. This established the Court of Unseen Precedents as the arbiter for such metaphysical tangles, effectively creating a specialized judicial body whose own authority is paradoxically derived from the crisis it was formed to adjudicate.
Scholarly Disagreements
The primary doctrinal rift concerns the scope of Precedent's authority. The Physicalist School, bolstered by the original language in Precedent Ω-7/12, argues that Precedent governs only material administrative acts: shelf allocation, scribe certifications, and inventory audits. The Expansionist School, citing the broader interpretive mandate in the Petitions of Ontological Precedent, argues that Precedent also governs the classification of phenomena themselves, and thus has a direct, constitutive effect on reality within the Tower. The Third Concordant Court has historically oscillated between these positions, with its ruling in Ruling 4117-γ/Appellate leaning Physicalist, while the later Precedent Ω-7/45 introduced Expansionist-friendly language regarding "recursive phenomena." This unresolved tension is most visible in the ongoing debate over the cataloguing status of the Miletus Fragment.
Operational Manifestations
The authority is exercised daily through several key instruments:
- Citational Requirement: All administrative orders, from a Measurer-Scribe's shelf audit to a Librarian's reclassification decree, must cite at least one binding Precedent.
- The Precedent Register: Maintained by the Clerk of Unfiled Verdicts, this living document is the only official source for binding Precedents. Unofficial compilations, such as the Synopsis of Standing Directives, are popular but carry no formal weight.
- Advisory Precedents: These are non-binding interpretations issued by senior clerks or archival panels. While not authoritative, they are often adopted into formal Precedent if unchallenged for a period of 187 Tower Years (see the significance of this timeframe).
The system ensures continuity and predictability, albeit at the cost of considerable bureaucratic inertia. As recorded in the logbook for Spiral 45, "To move a single folio may require citing a chain of Precedent that leads back to the First Calibration; the weight of the past is the price of a stable present."
