Right of Unreading

MS 8532.13 · Practices and doctrines

Right of Unreading is a procedural right, invoked within the Advisory Precedents, that permits the temporary ontological suspension of one or more codified legal interpretations. While superficially similar to a judicial recess, the Right of Unreading represents a formal, physical intervention into the legal corpus itself. It is distinct from the more permanent Ceremony of Unreading performed by the Chancellor, as its effects are provisional and subject to review.

Legal Basis and Mechanism

The right's foundation is derived from an inter-textual reading of the Third Concordance, Clause 14 (granting 'bodies of inquiry' the right to unscheduled consultation) and the Fourth Concordance, Annex 12, Clause vii (which states: 'The right to silence the worm is the right to author the law'). The Bureau of Consensual Realities interprets this as permitting a designated Body to "silence" a legal precedent—the "worm"—by physically removing its defining text from active catalogues for a prescribed period. This is achieved by submitting a Writ of Temporal Isolation to the Warden of Perilous Folios, who then sequesters the relevant folios in a designated spiral annex under a Sigil of the Closed Fist. During this period, the precedent cannot be cited, though its historical existence is not erased.

Invocation and Procedure

Only a Body of Inquiry granted Status Psi or higher may invoke the right. The petition must demonstrate that the precedent in question creates a "cascade of contradictory obligations" or obscures a "more foundational principle." Upon approval by a panel of three Senior Librarians, the Writ is issued. The sequestration lasts for a standard period of ninety-nine days, though this can be extended under the provisions of the Fifth Concordance regarding protracted hermeneutic crises. All parties with standing in matters governed by the sequestered precedent are notified via the Public Schedule, and a placeholder entry is inserted into the indices, marked with the Sigil of the Steady Hand.

Contested Interpretations

Scholarly debate centers on whether the Right of Unreading creates a true legal vacuum. The Guild of Exactitude argues it does, and that during the sequestration period, related matters fall under a default state governed by the Sanctity of Placement alone. Conversely, the Progressive Indexers' Collective maintains that the right merely "mutes" the precedent, and that its latent influence continues to shape rulings through what they term "echo jurisprudence," a concept related to—but distinct from—the typologies managed by the Bureau of Designation. This disagreement was most famously aired during the Ardis Vole petition of 312-, which required an emergency Advisory Precedent to resolve.

Relation to Other Rights

The Right of Unreading functions as a procedural cousin to several other key Tower rights. It is a less absolute instrument than the Ceremony of Unreading, a more formal one than the general public right to awareness. It often precedes the invocation of a Terminus Clause when consensus cannot be reached. Crucially, it interacts with the Ninety-Degree Shadow Rule; a precedent under sequestration is considered to cast "no shadow," meaning subsidiary rulings dependent on it may also be paused, a process governed by the Mask of Recursive Protocol.
