Adjudicators of Precedent

MS 3640.31 · Guilds, orders and offices

Adjudicators of Precedent are officially appointed committees tasked with parsing, verifying, and formalizing procedural and ontological precedents within The Tower. Their declarations, rendered as numbered precedents, possess the force of Concordance and are binding for all subsequent archival and adjudicative activity on the floors to which they are assigned.

Appointment and Composition

Adjudicators are drawn from the Register of Eligible Adjudicators, a roster maintained by the Bureau of Precedential Analysis. Per Concordance 712-δ, a standing committee must comprise no fewer than three and no more than seven members, one of whom is designated the Presiding Clerk. Appointment authority is a matter of frequent jurisdictional dispute. While the Bureau claims primary responsibility, the Adjudicators' Guild asserts historic privilege in vetting candidates, and the Office of the Archivist reserves the right to appoint ad hoc committees for precedents concerning foundational catalogue structures. The most notable such committee was that which established Precedent Alpha 1 1 in 312-7 (Spiral Reckoning), whose members were selected directly by then-Archivist-Logothete Valerius Kappa.

Function and Process

The primary function of an Adjudicator committee is to resolve ambiguities in the application of existing precedent or to establish new precedent where a procedural or categorical void is identified. A case is brought before them via a Formal Petition of Clarification, typically filed by a floor curator, a guild syndic, or, in rare circumstances, by an autonomous catalogue entity. The committee then enters a phase of Deliberative Seclusion, reviewing all relevant Precedential Cycles, Circulars, and competing Citations. Their final ruling is issued as a Precedent Document, which includes the precedent’s alphanumeric designation, a summary of the matter adjudicated, the ruling itself, and a dissenting opinion if one was recorded.

Notable Rulings

The body’s rulings form the substructure of Tower jurisprudence. Key precedents include:

  • Precedent Alpha 1 1: Established the principle that "a thing catalogued is a thing real within the bounds of its assigned floor," the foundational ontological axiom of the Tower.
  • Catalogue Node 77-Alpha v. The Silence That Preceded It: A landmark case wherein the Adjudicators ruled that a documented silence could hold procedural standing separate from the entity it surrounded, leading to the creation of auxiliary metadata protocols for negative space.
  • Precedent Γ-12/8: Formalized the procedures for a Provenance Challenge, directing such challenges to be filed with the Office of Provenance and assigning neutral adjudicators for any associated MAP-2 inquiries.

Scholarly Disputes

Significant controversy surrounds the hierarchy of adjudicative bodies. While the Adjudicators of Precedent are considered the standard arbiters, their authority is contested by two permanent bodies: the Judicial Precedent Guild, which advocates for a guild-centric model of precedent curation, and the Board of Concordant Interpretation, whose twelve permanent Readers claim ultimate authority in interpreting the foundational Concordances. This tension is exemplified by the ongoing dispute over the Calibration, Spiral Epoch, and Silent Shift precedent cluster, where rulings from different bodies offer contradictory guidance on temporal indexing.

Specialized Subsidiaries

Over time, specialized adjudicative practices have emerged, often operating under guild auspices. The most recognized are the Chromatic Adjudicators, individuals certified by the Ink-Mixing Guild to apply the Precedence of Hue in disputes involving manuscript coloration, pigment provenance, and the legal weight of marginalia. Their rulings, while technically subordinate to general precedent, are rarely overturned due to the highly technical nature of their domain.

Archival Status

The complete registry of Adjudicator committees and their outputs is maintained in the Hall of Echoing Verdicts on Floor (designated "The Precedential"). Access is restricted to appointed Adjudicators, senior scribes of the Bureau, and entities directly named in a precedent. Notably, Precedent Sigma12 explicitly forbids the cataloguing of the Adjudicators themselves, rendering them an administrative function that exists only through its output, a condition often cited in debates about the nature of procedural ghosts within the Tower's architecture.
