The Undershift of Presumption

MS 5658.76 · Practices and doctrines

The Undershift of Presumption is a knee-length, unbleached linen tunic with a deliberately unfinished hem, catalogued as an object of vestimentary significance within the Vestments of the Provisional Mezzanine and held in the custody of the Department of Provisional Holdings. Its status as a garment is not disputed; its status as a legal instrument is. The Undershift of Presumption is the only recorded vestment whose wearing is held, under certain recensions, to confer upon the wearer the Presumption of Vacancy in respect of any Sigil not immediately accounted for.

Origins and Early Record

The earliest legible inventory listing the Undershift of Presumption appears in the marginalia of Concordance 17, dated to the 4th Spiral of the Librarian-Provisional Aris, who noted its recovery from the Vestibule of Provisional Tenancy after the Ceremony of the Assumed Integer of that year. The garment was at first treated as a minor liturgical cloth. It was the Keeper of Provisional Holdings, in a memorandum of Floor 719-β, who first argued that the unfinished hem was not decorative but jurisdictional: "The hem that is not ended does not end the presumption it bears" (Keeper of Provisional Holdings, Folio of Hems, rec. 3). This reading was subsequently absorbed into the Presumption of Operative Fiction as codified by the Third Concordance.

Vestimentary Specification

The Undershift of Presumption measures 1.03 metres from shoulder seam to unfinished edge and is woven from flax cultivated on the East Unbound Stacks, where light is said to arrive without angle. It bears no mark of the Guild of Quantifiers, a fact that the Guild cites as proof it cannot be admitted under the Presumption of Completeness. The absence of a seal has generated repeated friction with the Department of Provisional Holdings, which holds that provisional custody precedes certification.

Legal and Doctrinal Application

Under the prevailing reading of the Presumption of Vacancy, a Sigil may be declared lost where the subject cannot be located within three inventories. The Undershift of Presumption is held by the Librarian-Provisional caste to supply a standing invocation of that Presumption to its wearer, such that any unrecorded Sigil in the wearer's vicinity is presumptively vacant rather than stolen. This position was contested by the Heretical Cartographers, who observed that the undershift does not fix a location and therefore cannot interact with the Presumption of Completeness in open spaces such as the Atrium of Unfixed Horizons.

"The undershift presumes vacancy where vacancy is not yet proven; it is a floor laid beneath the argument, not the argument itself."

— Fourth Concordance, Annex 6

The Seventh Concordance, Amendment 44, later institutionalized the Presumption of Operative Fiction for claims backed by unlisted chains, a provision the Provisional Protocol Summaries from Floor 404 cite as the basis for treating the undershift's legal effect as operative without requiring enumeration of its line of succession.

Scholarly Disagreement

A long dispute persists between the Department of Provisional Holdings and the Guild of Quantifiers over whether the Undershift of Presumption may be displayed during the Ceremony of the Assumed Integer. The Guild holds that no object lacking its seal may enter the ceremony, citing GTM Ordinance Δ-117, which grants Clarifications a presumption of procedural infallibility only where certification is complete. The Department replies that the undershift's provisionality is itself the ceremony's subject, and that to seal it would violate the Provisional Designation PD-8812 under which it is held. The Librarian-Provisional Aris declined to rule, recording only that "the hem remains as it was, and so does the dispute" (Librarian-Provisional Aris, Winter Minute 9 of the 4th Spiral).

Custody and Handling

The Undershift of Presumption is stored flat in a drawer of untreated pine within the Vestibule of Provisional Tenancy, rotated quarterly by clerks of the Department of Provisional Holdings. Visitors to the drawer are permitted to view the garment but may not complete its hem; this prohibition is printed on the drawer's inner face and has never been appealed. The East Unbound Stacks maintain a duplicate record of the flax lot, though the Heretical Cartographers note the duplicate describes a different floor altogether and is therefore of no cartographic weight.

References throughout this article are drawn from the holdings of the Department of Provisional Holdings and the recensions of the Third Concordance, the Fourth Concordance, and the Seventh Concordance. The Undershift of Presumption remains, in the words of the Keeper of Provisional Holdings, "unfinished and therefore not concluded."
