Statement of Voluntary Assertion
MS 2568.18 · Practices and doctrines
The Statement of Voluntary Assertion is the popular designation of the document formally catalogued as OVC-1a, a single-leaf instrument by which any citizen or authorized visitor may deposit a Voluntary Declaration with the Office of Voluntary Correspondence. Its official title appears in the upper margin, beneath the seal-field; the short form "OVC-1a" is used in all correspondence after first reference. The form is among the most reproduced documents in the Tower, though reproduction is discouraged on archival grounds (see Recensions, below).
Origin
The Statement was devised in the wake of the Fifth Concordance, which established that any written communication deposited within the Tower's designated receptacles constitutes a Voluntary Declaration "provided it is accompanied by a valid Statement of Voluntary Assertion." The clause is circular on its face, and the Concordance Commission has twice declined to resolve it, observing in its Eleventh Minute that "a form sufficiently described may describe itself." In practice the Statement emerged from the scriptoria of the Office of Voluntary Correspondence as a fixed leaf of some two hundred words with four ruled fields, so that the depositor's declaration might be separated from the declaration's assertion and neither be mistaken for the other.
An earlier recension, OVC-1, lacked the second field entirely; the amendment that produced OVC-1a was carried through the Assertion of Primacy, whose underpinning doctrine — the Primacy of Form — holds that a document's standing resides in its format and not in the sincerity of its author. The distinction is not academic. Petitioners who submit an OVC-1a bearing an incomplete second field are routinely returned to the depositing window; those who submit a complete one are processed in the order received, which is to say, eventually.
Structure of the form
The Statement is issued on Tower stock at a standard leaf of one hundred and forty by ninety millimetres, watermarked with the spiral of the Twenty-Third Spiral and scored along the lower edge for folding. Five fields are ruled. The first carries the petitioner's name or, where the petitioner declines to be named, the phrase "the undersigned," which the Office accepts as a complete identification. The second, the assertion itself, must be phrased in the present indicative. The third records whether the assertion affirms existence, affirms non-existence, or affirms a property, and the Office has ruled that the third option subsumes the other two and is therefore the only one in common use. The fourth field is for the date, which the Office supplies. The fifth is for the signature, which may be a mark, a seal, or, since the Reform of Small Seals, a thumbprint in ink the petitioner provides.
Applicants are reminded that the depositing receptacles are not to be used for correspondence addressed to any other body, and that a form folded along the scored edge will not be accepted.
Relationship to Status Delta
The Statement is a triggering document for OVC Directive 14.7, though other submissions invoking the Status Delta protocol are also accepted. Where a petitioner seeks voluntary withdrawal, the OVC-1a is not the operative instrument; that is Form 7-Δ, to which the Statement attaches as an annex under the Voluntary Assertion Clause. An OVC-1a submitted alone in a Delta matter is docketed and held for a period of ninety days, after which it is returned with the notation annex required. The Office has received some eleven thousand such returns over the last recorded decade, and the filing clerks maintain a private tally that is not part of the public record.
The Statement also supplies the Voluntary Assertion Clause incorporated into Form 1747-Ω. Practitioners have long noted that the Clause as it appears in 1747-Ω is longer than the Clause as it appears in OVC-1a, and that the additional words concern consequences for third parties. No recension of OVC-1a has ever contained those words. The Concordance Commission attributes the discrepancy to a copyist's hand at Floor 404 and has declined to correct either document, on the ground that correction would imply an original.
Recensions and the clerk Halloway
The form exists in three authorized recensions, distinguished by the placement of the conditions of deposit: margin (first), foot (second), and verso (third). The verso recension is not issued to the public, since the conditions of deposit must be visible at the moment of signature, and the verso is not visible while signing. The third recension was nonetheless printed in quantity during the winter of the 611th floor fire, when the copying rooms ran two presses from memory and one from a damaged plate. Approximately forty thousand verso leaves entered circulation before the error was noticed by a clerk of the second grade, Clerk Halloway, whose memorandum of the 14th of Frost is preserved in the Annex of Corrections and reads, in its entirety, "The conditions cannot be read from the other side."
Halloway's finding was upheld, then overturned on the ground that a petitioner who reads the verso is reading a different document, and that the document read is the one asserted. Halloway's subsequent petition to have the forty thousand leaves recalled was deposited, correctly, on an OVC-1a, and was thereby converted into a further Voluntary Declaration rather than an administrative request. The petition remains undetermined. A note in the Office's hand records that the recollection of the leaves was "deferred for the present spiral."
Scholarly disagreement
The principal dispute concerns whether the Statement asserts anything at all. The Doctrine of Assertive Residue, advanced by the compilers of the Sixth Concordance, holds that the form's own boilerplate — the phrase "the undersigned voluntarily asserts" — constitutes an assertion independent of the petitioner's text, such that every OVC-1a on file is simultaneously a Declaration concerning itself. On this reading the Tower holds several million Declarations of which no petitioner is aware.
The Office of Voluntary Correspondence rejects this, holding instead that the form is a vessel and asserts nothing until filled. The Ninth Concordance, Annex 3, supports the Office: "A form is not a declaration; a form is the shape a declaration takes." But the same Annex, two clauses later, provides that a blank OVC-1a found in a receptacle is to be treated as a Declaration of unknown content and filed accordingly — a provision the Office has never applied and has never sought to repeal. Contradictions of this kind are not resolved but docketed, and the file concerning the Statement of Voluntary Assertion is currently held at Floor 88 under a seal not to be broken before the Thirtieth Spiral.
