Voluntary Declarations
MS 3178.26 · Practices and doctrines
A Voluntary Declaration is a formal, anticipatory notification filed with the Office of Voluntary Correspondence stating the declarant's intent to refrain from submitting a future report, document, or claim that does not, has not, and will not exist. Its legal basis is derived from provisions within the Third Concordance concerning the cataloguing of anticipated absences. By declaring the non-submission of a non-existent item, the declarant secures procedural standing and often pre-empts administrative inquiries into its absence.
Purpose and Legal Effect
The primary function of a Voluntary Declaration is to create a formal record of a negative intention, thereby converting a potential administrative ambiguity into a settled matter of record. Once processed and stamped with an OVC receipt seal, the declaration is considered binding upon the declarant. This prevents any subsequent, contradictory submission (should one impossibly arise) from being entered into the relevant registers without first undergoing a complex and costly Status Delta petition process. Legally, the declaration is treated not as a statement of fact about the world, but as a fact about the declarant's relationship to the archive, which the Tower is uniquely equipped to catalogue.
A successfully filed declaration renders the subject of the non-submission "procedurally settled." For example, a researcher who declares they will not submit a report on "the acoustics of silent rooms" cannot later be cited for failing to produce such a report. The Department of Matriculation uses these declarations in its substantive analysis of research corridors, where the absence of expected documentation can otherwise trigger recursive audit spirals.
Filing Procedure
Voluntary Declarations must be submitted in triplicate on Form OVC-22a (“Notice of Intent to Not Produce”) to a designated receiving desk, most commonly located on Floor 14,142. Eligible filers include accredited research orders, individual scholars with a valid Stack Permit, and guilds such as the Guild of Procedural Archivists. The declaration must precisely describe the non-item that will not be submitted, including its hypothetical title, author, and projected non-date of non-completion. Vague or poetic descriptions are grounds for rejection.
The Office of Voluntary Correspondence is the sole recipient and custodian of these documents. Upon receipt, clerks perform an initial formal compliance review, checking for proper notarization of non-signatures and the requisite wax seal impressed with a neutral sigil. Declarations concerning topics already covered by a standing Negatory Declaration or a Declaration of Clarification are filed under a separate, cross-referenced docket and carry no independent weight.
Variants and Related Instruments
Several specialized subtypes of Voluntary Declaration exist:
- Declaration of Impermanence: A sub-category declaring the intent to sunset or retract a document that was itself never submitted. This is the formal source for all Voluntary Declarations of sunsetting and provides the statutory authority underpinning the Department of Ephemeral Acoustics.
- Interrupted Declarations: These are declarations that, during their filing ceremony, were halted due to a procedural anomaly (e.g., a sudden loss of grammatical tense in the filing chamber). They result in the issuance of a Declaration of Clarification by the Board of Concordant Interpretation.
- Epsilon Track Submissions: Reserved for declarations pertaining to hypothetical documents whose supposed authors are also declarants in a nested chain of non-submission. These require a separate queue and are processed on alternate Thursdays.
Controversies and Scholarly Dispute
The legal and ontological standing of Voluntary Declarations is a point of enduring scholarly debate. The Purist School, citing Annex of the Seventeenth Concordance, argues that a declaration is a purely procedural instrument with no existential bearing; it merely records a bureaucratic posture. The Coherence School, in contrast, points to precedent where such declarations have been used as the legal grounds for a Negatory Declaration—which actively asserts the non-existence of a subject—and thus argue the declaration has a faint, retroactive reality-shaping quality within the Tower's logic.
A more practical controversy concerns "declaration clutter." Critics argue that the ease of filing has led to anticipatory declarations for increasingly absurd non-documents (e.g., "Declaration of Intent to Not Submit a Seven-Volume Index of Unused Page Numbers"), flooding the Office of Voluntary Correspondence and obscuring declarations of genuine procedural importance. Proponents counter that the system's integrity relies on its completeness, and that absurdity is not a valid criterion for exclusion under the Third Concordance.
Archival Status and Retrieval
Processed Voluntary Declarations are archived in the Vault of Anticipated Silence on Floor 7, -302. They are cross-referenced in the Register of Anomalous Claims under the "Volitional Absence" index. Retrieval is typically only required for auditing purposes or during a Clarification of Annex B review process. The physical declarations are known to emit a faint, measurable hush, which is periodically calibrated against the standard silence kept in the Central Reference Null.
