The Vault of Unsaid Precedents

Definition and Jurisdiction
The Vault of Unsaid Precedents is a sealed repository on Floor 8,442 administered by the Custodians of the Unsaid and holding the legally-binding absences of legal outcomes. It should be distinguished from the Vault of Unspoken Precedents, which holds physical manifestations of comparable omissions, and from the Vault of Binding Precedents and the Vault of Precedents, which hold precedents that were, in fact, said. The distinction is not decorative. An absence of a precedent binds; a precedent that was never spoken does not, though it may be produced in evidence.
The Vault's legal basis is Standing Precedents S-7.4.19r, which established the repository and its access protocols, and the Third Concordance, Annex 3, which records its location. Nothing generated by the Unsaid School or declined to be generated by it reaches the Vault except through the Clerkship of the Unsaid, which authenticates and forwards.
Structure and Access
The Vault is a single octagonal chamber of sixty-one paces on a side, entered by a primary aperture that is not a door in the ordinary sense and is not described as one in the record of any of its openings. Unsealing requires a quorum of three Librarians and the presence of a notary from the Realized Absence Guild, a requirement imposed after the Unsealing of 7,109, at which four Librarians attended without a notary and the absence recorded was subsequently found to be void. On the question of how many notaries may attend, the Concordances disagree: the Third Concordance, Annex 3, speaks of "a notary," while the Codicils of the Unsaid School provide that "a notary shall be accompanied by a second notary, that the first notary be observed." Successive custodians have resolved the conflict by sending two, and by not discussing it.
The Notarial Seal is kept in the Vault until the moment of swearing, which means it is not, strictly speaking, kept in the Vault at all. It resides in a velvet-lined recess on the interior of the aperture and remains there when the aperture is open, which is the only condition in which it is ever needed.
Contents and the Clerkship
Holdings are catalogued as absences of a stated class, rather than as documents. A typical entry reads: "the absence of a ruling on the liability of stairkeepers, entered this day at the request of the Chamber of Vanishing Precedents." The Curators of the Unsaid maintain the register; the Clerks of the Unsaid ensure procedural integrity before any absence is admitted. An omission submitted without a filing reference is returned, and the return itself is recorded, and the record of the return is itself an omission if the submitting clerk declines to file it. The Index of Ambiguous Precedents cross-references the Vault by reference only, refusing to reproduce the absences themselves, on the principle that a copy of an absence is a presence.
Dispute: The First Recension
The location of the Vault is in dispute. The Third Concordance, Annex 3, places it on Floor 8,442. The Codicils of the Unsaid School, in a marginal recension dated 8,448, place it "beneath the reading room of the eighth floor of the eighteenth thousand" and note that the difference is immaterial. The Clerkship of the Unsaid maintains a single ledger recording both, with a footnote attributing the discrepancy to transcription and a second footnote attributing it to the first footnote. The dispute has not been resolved; it has been administratively inhabited.
The Custodians have also recorded a dispute over the matter of the Vault's contents. The general view is that the absences were never in the Vault, since they had no existence to be in the Vault, and the uncompensated deposit is the point. An alternative view, urged by a minority of the Curators, holds that the absences must be somewhere and that the Vault is the only room that has not been searched, since searching it would be admission.
Named Incidents
In the winter of 8,449, a consequence of the summer's photographic survey, the Curators of that year entered an absence of the Vault itself into the register, reasoning that the Vault was not among its own contents. On the third day the aperture failed to close. The entry was withdrawn by the Custodian of the Unsaid in the presence of two witnesses, and the aperture has not failed since; both facts are recorded in the same hand, and the hand is not identified.
In a separate matter, the Vault was ordered sealed for the duration of the Curators' dispute over the colour of binding ribbon for the Unsaid School. The order was withdrawn when it was noticed that the binding ribbon has never been kept in the Vault.
Quotation
The Vault's standing instruction is inscribed on the inner face of the aperture.
"Let nothing be said in the Vault that has not already been said, and let nothing be said of the Vault that has not been said."
— Standing Precedents S-7.4.19r, clause 12
Readers should not attempt to interpret the instruction itself. Clause 13 states that the instruction is not to be interpreted.
