Regulatory Framework

MS 2906.71 · Practices and doctrines

Regulatory Framework refers collectively to the hierarchical corpus of administrative, structural, and legal doctrines that govern all operations, classifications, and spatial-temporal relationships within the Tower. It is not a single document, but a dynamic and often contradictory system composed of Concordances, Ordinances, Edicts, Protocols, and their annexed commentaries. The ultimate authority and source of any given Framework is a subject of continuous hermeneutic analysis by the Librarians.

Structural Hierarchy

The Tower's Regulatory Framework is organized in a non-linear, accretive hierarchy. At its apex are the Major Concordances, such as the Third Concordance and the Spiral Concordance, which establish foundational principles across multiple departments or floor ranges. Subordinate to these are Department-specific frameworks, like those administered by the Department of Ambient Physiology or the Department of Vital Statistics. Procedural details are then elaborated through Ordinances (e.g., the Ordinance on Rotational Infrastructure), Edicts (e.g., the Volumetric-Temporal Edicts), and finally, operational protocols like the Seventeenth Provisional Protocols or Standard Measurement Protocol (SMP-Δ). A lower-tier document can, through precedent and sustained application, effectively amend a higher one, a process formalized under the Edicts of Mediate Resolution.

Doctrine of Applicability and Contradiction

A core tenet of the Framework is that multiple, contradictory regulations can be simultaneously valid. Applicability is determined by context-specific criteria including, but not limited to: the chronological stamp of the holding, its volumetric classification, the affiliated guild of the inquiring party, and the ambient luminosity at the point of consultation. The Hierarchy of Constructed Coherence provides a methodological guide for resolving such conflicts, prioritizing frameworks based on a rotating schedule of "Interpretive Priority" published in Annex bulletins. For example, while the Twenty-Third Concordance broadly governs Apertures, a dispute involving an aperture's olfactory emissions would defer to the Ordinance of Olfactory Neutrality.

"The Framework is not a map of the Tower; the Tower is a physical manifestation of the Framework."
— Commentary on the Preambles, Vol. XXII, Shelf 7-Δ

A common, if contentious, hermeneutic position among procedural scholars.

Generative and Classificatory Function

The Framework does not merely govern existing phenomena; it actively generates taxonomic categories and, by extension, the realities they contain. The classification of a substance as Alloy Ω-7 under Precedent Ω-7/12, or the designation of a space as a Liminal Reservoir under Concordance 77, brings those entities into full operational reality within the Tower's jurisdiction. This principle is most clearly observed in the handling of Ambient Regret and other non-corporeal holdings, whose very existence and properties are defined by their governing regulatory documents.

Annexation and Special Administrative Zones

Certain areas operate under bespoke or semi-autonomous frameworks. Annex Epsilon, for instance, serves as the primary regulatory framework for the Ambulatory Annex, its rules co-existing with those of the main Tower under a principle of "Joint Sovereignty." Similarly, the Cultivar Standards apply exclusively to the hydroponic sectors on Floors 304-307, creating a self-contained regulatory ecosystem that interfaces with the Tower's wider Ordinance of Vital Circulation only at specified transfer airlocks.

Scholarly Disputes

The principal unresolved debate concerns the origin of the Frameworks. The Proceduralist School argues they are constructed instruments, continuously amended by the Librarians through observed necessity. The Revelationist School contends the Frameworks are discovered, not made—that they represent the underlying axiomatic structure of the Tower itself, with Librarians serving as scribes and interpreters. This dispute has practical ramifications; a Proceduralist reading of the Concordance of Acquisition permits more aggressive re-classification of holdings, while a Revelationist reading demands strict adherence to originally documented states, as seen in the prolonged dispute over the Silence holdings in the West Stacks.

Amendatory Processes

Amendments occur through several channels: the issuance of a new Concordance (a rare event), the addition of an annex to an existing framework, the establishment of a binding precedent through a ruling by a Designated Receiver, or the passive obsolescence of a clause through universal non-compliance. The latter is the most common but least documented method. For instance, Clause 881 of the Twenty-Third Concordance, governing the lubrication frequency of certain aperture gears, is universally ignored in favor of the tactile "hum-test" described in an uncatalogued mechanic's manual, effectively creating a new, unwritten regulatory standard.
