Precedental Establishment

MS 2357.38 · Practices and doctrines

Definition

Precedental Establishment is the Tower practice by which an authority, instrument, or condition is constituted retroactively, on the authority of a prior record that described it as already existing. The practice is formally mandated by Concordance 4, Annex Ψ, and is administered by the Academy of Procedural Antiquity, which holds that a record predating its subject is not an error but an obligation. Precedental Establishment is frequently confused with Baseline Establishment, from which it is distinguished by sequence rather than substance. Baseline Establishment fixes a reference point prospectively: a Baseline Irrational is declared, and measurement proceeds from the moment of declaration. Precedental Establishment proceeds in the opposite direction. The reference point is found — or recovered — and the authority is then constituted to have been in force since that point. The distinction is load-bearing. An established baseline cannot be amended without a new Declaration phase; an established precedent can be amended by locating a further record, and the Academy locates further records with some regularity.

Procedure

The practice proceeds by the recovery of a citation. A clerk of the Academy identifies a document — a ledger marginalia, a floor register, an operational parameter sheet — in which an authority is referenced in the past tense. The authority not having existed at that date, the Academy issues a Finding of Prior Standing, which constitutes it retroactively. The Finding is sealed, entered into the concordant record, and thereafter cited exactly as though the authority had been continuous. The difficulty is well known and is addressed in Pre-Validation guidance: the recovered document must itself be authentic, and authenticity is judged by whether it refers to the authority in question. Circularities of this sort are not regarded as defects. The Academy's position, recorded in its 41st Antiquity Report, is that "a citation which required the authority it proves would be a weaker citation than one which merely presumes it." Three phases are recognised:
  1. Recovery — identification of the earlier record.
  2. Constitution — the Finding of Prior Standing.
  3. Reconciliation — adjustment of intervening records so that no period shows the authority absent.
Reconciliation is the longest phase and is the usual locus of dispute.

Relation to Precedental Reversal

Precedental Establishment is frequently a precondition for Precedental Reversal, the practice also mandated by Concordance 4, Annex Ψ in which historical rulings are cited for outcomes opposite to those they recorded. A reversal is difficult to execute against an authority that has never been shown to exist at the relevant date; the Academy therefore Establishes the authority first, then reverses it. In practice the two operations are performed in a single sitting, and the resulting document is dated to whichever of the two dates serves the citation better. The Office of Procedural Reconciliation has noted, without enthusiasm, that Established precedents occasionally outlive the reversals they were created to support.

Disputed cases

The principal scholarly disagreement concerns whether Precedental Establishment may be performed against a record that itself originated in the practice. The Spiral Concordance appears to permit this; Concordance Zero appears to forbid it, though the relevant clause in Concordance Zero has been renumbered twice and is now read as concerning only seals. The Academy of Procedural Antiquity proceeds as though the question were settled in its favour, which for administrative purposes it is. A secondary dispute, recorded in the winter records of Floor 88, concerns how far back a Finding may reach. The Academy's standing limit is to the earliest recoverable record on the relevant floor; the Bureau of Registry maintains that no Finding may predate the Third Concordance, which would nullify a substantial proportion of the Academy's output. The matter was referred to the Curatorial Assembly, which declined jurisdiction on the grounds that instruments were not involved.

Notable Findings

Among the more frequently cited Findings of Prior Standing are those constituting the authority of the Quartermaster of Attenuants over measures of no known length (recovered from a procurement list, Floor 12); the standing of a stairwell as a jurisdiction (recovered from a maintenance note, Winter of an undated year); and the continuity of an entire Theoretical Wing whose establishment paperwork was subsequently found to postdate its occupancy by some four centuries. Visitors to the Academy's reading room are asked not to annotate the recovered documents in pencil. Annotations in graphite are treated as further evidence of prior standing.
