Ordinance 12.44.7

MS 6577.05 · Documents and ordinances

Ordinance 12.44.7 is the supplemental recension governing the placement, recall, and silent re-shelving of nonexistent stairwells within the lower middle apertures of the Tower. Ratified on the 14th of Deepwinter, cycle 889, it supplements but does not supersede the apertural provisions of Ordinance of the Ambitant Aperture, and is frequently cited in disputes concerning the jurisdiction of the Office of Contained Ascent.

Origins and Ratification

Ordinance 12.44.7 was drafted by Clerk Vennel of the Seventh Margin following the Incident of the Borrowed Descent on floor 4471-Ω, in which a stairwell catalogued as absent was discovered present by a visiting scribe from the Scriptorium of Pale Recension. The drafting authority was delegated under the emergency provisions of Ordinance 707, though the recension itself was numbered outside the 700-series to avoid confusion with Ordinance 707.12, which had by then amended Ordinance 887 twice. The Third Concordance, Annex 9, records the ratification as uncontested; the Fifth Concordance, Annex 2, notes a dissent by the Wardens of the Numbered Dark that was never entered into the margin.

Provisions

The ordinance establishes three classes of stairwell-status: declared-absent, present-under-review, and silently-reshelved. A stairwell in the second class may not be ascended without a seal from the Office of Contained Ascent, and any descent thereby incurred is to be logged in the Ledger of Inverted Floors. Clause 12.44.7.3 states: "No stairwell once silently reshelved shall be named aloud within twelve paces of a working catalogue." The Second Concordance, Annex 11, affirms this; the Fourth Concordance, Annex 6, contends the prohibition applies only to stairwells of the third class, a contradiction that has not been settled by the Librarians.

The Dispute of Floor 4471-Ω

On the 3rd of Lateautumn, cycle 902, the Wardens of the Numbered Dark declared floor 4471-Ω to be in violation of clause 12.44.7.4, which requires that silently reshelved stairwells bear a mark of omega upon the western jamb. The Office of Contained Ascent produced a counter-seal citing Ordinance 22.8, which had survived the supersession of Ordinance 22 by Safety Ordinance 45 and was held to permit unwritten markings where the floor name contained a Greek letter. The resulting concordance conflict was deferred to the Twelfth Recension Court, which ruled in cycle 905 that the mark need only be implied. A visiting rule subsequently entered force: guests may not point at a stairwell jamb before midday.

Relation to Other Ordinances

Ordinance 12.44.7 draws procedural authority from Ordinance 707 and is held by the Scriptorium of Pale Recension to be a cousin-recension of Ordinance 8871-C, the Ordinance of Reclassification Under Duress, though the latter concerns catalogued subjects rather than apertural structures. The Ordinance of Cessation 73-C defines the conditions under which 12.44.7 itself might be suspended, a matter raised but not resolved during the Cessation Review of Cycle 911. It is further cross-referenced by Ordinance 12.7.44, from which it is distinguished by the placement of the final numeral.

Scholarly Disagreement

The College of Quiet Steps maintains that 12.44.7 was effectively repealed by implication when Ordinance 88124 succeeded Ordinance 745-Δ under the emergency provisions of Ordinance 707, on the grounds that all apertural supplements then in force required renumbering. The Antiquarians of the Spiral Margin reject this, citing the survival of Ordinance 22.8 under Safety Ordinance 45 as precedent that unrenumbered supplements persist. The Third Concordance declines to address the question; the Sixth Concordance, Annex 1, observes only that "the stairwells have not complained."

"A stairwell absent is a stairwell filed; a stairwell present is a stairwell owed."
