Jurisdictionally Un-Rung

MS 5285.35 · Practices and doctrines

Jurisdictionally Un-Rung is a specific sub-classification of Un-Rung Bells, defined by both its acoustic potential and its unresolved legal status. The term denotes an Un-Rung Bell whose potential resonance is entangled in one or more active administrative disputes, rendering its official Jurisdictionally Contested designation contingent on the procedural outcome.

Definition and Sub-Classification

The classification originates from a cross-reference between Annex δ, Clause 4 and the Manual of Dispute Resolutions (Appendix 7, "Cases of Pre-emptive Silence"). A bell is designated Jurisdictionally Un-Rung when, upon its discovery and preliminary logging, a concurrent Notice of Contested Interpretation (Form 88-G) is filed concerning which body holds custodial authority over its un-rung state. As per the PIAC, it constitutes the second of the three sub-classifications, distinct from "Inherently Un-Rung" and "Ceremonially Un-Rung."

Unlike a standard Jurisdictionally Contested item, which may involve any subject, a Jurisdictionally Un-Rung bell's contested nature is intrinsic to its definition. The dispute is not merely about custody; it is about whether the Receivers of Absence or the Academy of Procedural Ghosts (or another body) has the authority to define the bell’s potential soundscape, a decision which will retroactively determine its prior ontological status.

Procedural Pathway

Upon identification, a Jurisdictionally Un-Rung bell must be entered into the Central Log of Contested Holdings with a special "auditory-pending" flag. It then enters a state of Provisional Logging for up to 60 solar cycles. During this period, three reviews are mandated:

  • A physical audit by clerks from The Floor of Silent Bells to confirm the bell's material stability in its un-rung condition.
  • A jurisdictional hearing before the NOC Committee to examine the competing claims cited in the initial 88-G form.
  • A final assessment by the Court of Silenced Appeals, whose ruling determines the bell's final classification and its authorized movement to a permanent holding floor.

Until the Court's ruling, the bell is physically quarantined in a designated annex of The Floor of Silent Bells. Its transportation is governed by strict protocols and can only be conducted by the Couriers of the Silent Stair, whose routes are not a matter of public record. As stated in Concordance 27, Clause 12, "The silence of the bell is inviolate until jurisdiction is resolved; any accidental or incidental vibration during transit voids the case and consigns the subject to the Subbasement."

Notable Cases and Precedents

The most cited precedent is In re: Aperture-Gamma Bell (Spiral 889), where a deadlock between the Receivers of Absence and the Custodian of the Stacks over cataloguing methodology kept the bell in a Jurisdictionally Un-Rung state for 214 cycles. The ruling established the principle of "Volumetric Equivalence," holding that the theoretical sound of the bell must be matched to a corresponding volume in the Central Index before custody can be assigned.

Another unresolved case involves the so-called "Fourth-Course Bell," a vessel bearing striking physical resemblance to the Silent Chime used in the Feast of Nullity. Two separate Concordance 11 documents pertaining to ceremonial silence and culinary acoustics are in direct conflict, a situation which, per statute, automatically triggers the Jurisdictionally Un-Rung classification. It currently resides in a vibration-dampening cell in the Dim Galleries.

Scholarly Disagreement

A significant doctrinal split, known as the Source Debate, centers on whether the jurisdictional dispute creates the bell's un-rung status, or whether the bell's inherent un-rung nature inevitably attracts jurisdictional conflict. The "Proceduralist School," championed by the late Archivist-Lawyer Holus, argues the former, citing clauses in the Manual of Dispute Resolutions. The "Inherency School," whose views are often echoed by the Warden of Unnumbered Floors, argues for the latter, suggesting that such bells are drawn to areas of administrative ambiguity in the Lower Reaches.

"The dispute is not an accident of filing; it is the bell's final, unwritten resonance." – Footnote 44, Treatise on Acoustic Jurisprudence, from the private stacks of the Court of Silenced Appeals.

This debate has practical implications for retrieval expeditions. Proponents of the Inherency School advocate for searching areas near administrative boundaries, such as the landings of the Stair of Silenced Bells, while Proceduralists focus audits on clerical departments with high rates of 88-G form submissions.
