Custodial Mandate
MS 0784.79 · Documents and ordinances
The Custodial Mandate is the principal legal instrument by which the authority and responsibilities for the care, preservation, and administration of the Tower's assets are delegated to individuals, guilds, or offices. A Mandate constitutes a grant of custodial power, specifying the scope, limitations, and subject matter of the custodianship. Unlike a Custodial Sigil, which is a material token of authority, a Mandate is a recorded document, filed within the relevant Concordance annex and subject to amendment, appeal, and periodic review via the Custodial Strain Review process.
Structure and Issuance
All Custodial Mandates are structured according to the standard template codified in Annex III of the First Paradoxical Provision and elaborated upon in the Manual of Custodial Protocol (Revision 43). A valid Mandate contains, at minimum, the following elements: the designation of the issuing authority (typically a Librarian or a recognized custodial syndicate); the unique Mandate number and revision index; a precise enumeration of the subject under custodianship (e.g., "the atmospheric drift of Floor 743" or "the catalog of Unhad Dreams"); the specific powers granted; any explicit limitations or prohibitions; and the Mandate's expiration clause or condition for renewal.
Mandates are issued by bodies with pre-existing custodial authority. For example, Custodial Mandate 117 was issued by the Office of Archival Stewardship to establish the Office of Esoteric Redaction. The Custodial Guild derives its foundational authority from Clause 401.7 of the Fourth Concordance, which serves as a perpetual Mandate for its operations. In cases of newly discovered phenomena or spaces, a Mandate may be issued provisionally by the senior Librarian on-site, pending formal ratification.
Classes of Mandate
Custodial Mandates are categorized into five classes, which determine the scope of the custodian's authority and the procedures required for its exercise.
- Class-1 (Preservation)
- Grants authority for maintenance and stabilization only. The custodian may not alter, relocate, or interact with the subject beyond actions necessary to prevent decay or collapse. The mandate governing the Salt Flats Curatorial Authority is a noted Class-1 example.
- Class-2 (Stewardship)
- Allows for active curation, cataloguing, and non-destructive study. Most archival floors operate under Class-2 Mandates issued to their resident guilds.
- Class-3 (Intervention)
- Permits measured alteration, relocation (subject to Custodial Chain protocols), and authorized interaction. A Librarian holding a Class-3 Mandate may initiate procedures such as Archive Forwarding.
- Class-4 (Reclamation)
- Grants broad authority to restore a subject from a state of disorder, anomaly, or contradiction. Often issued temporarily to bodies like the Department of Paradoxical Reckoning.
- Class-5 (Sovereign)
- Confers near-total authority over the subject, including the power to define its fundamental properties. These are exceedingly rare and are typically held only by the most senior Librarians or foundational guilds, such as the Chronurgy Guild's mandate over temporal apparatus.
Custodial Overlap and Conflict
A persistent administrative challenge is the phenomenon of Custodial Overlap, where two or more valid Mandates claim authority over the same subject or geographic area. A canonical example is the long-standing dispute between the Custodial Guild of Floor 707 and the Custodial Corps of Floor 708, both of which assert sweeping rights over the interstitial stairwells and auxiliary shelves between their domains. Their respective Mandates, derived from Clause 401.7 of the Fourth Concordance and the Eighteenth Concordance respectively, are mutually incompatible in their particulars.
Resolution of such conflicts falls to the Custodial Syndicate, which may either amend the conflicting Mandates, designate a primary custodian, or, in intractable cases, issue a new, superseding Mandate that forcibly reconciles the claims. The process is detailed in the Manual of Custodial Protocol under "Protocol for Adjudication of Conflicting Stewardship."
Limitations and Expiration
No Custodial Mandate is considered permanent unless explicitly declared "in perpetuity" by a Concordance clause. Most contain sunset provisions tied to a specific event (e.g., "until the subject's cataloguing is complete"), a temporal period (e.g., "for a span not exceeding one centennial"), or the tenure of the designated custodian. Upon expiration, the Mandate must be renewed, allowed to lapse, or transferred via the formal Custodial Chain procedure.
A Mandate may also be revoked for cause by its issuing authority, or suspended by the Custodial Syndicate pending a Custodial Strain Review. Such reviews assess whether the custodial duties have produced "unacceptable ontological strain" on the subject or surrounding archive. The controversial revocation of the Physickers of the Deep Font's Mandate in 712-̸α (After Inception) is a frequently cited case study.
Scholarly Disagreement
A significant doctrinal dispute concerns the source of a Mandate's authority. The Formalist School, citing the Third Concordance, holds that a Mandate's power derives solely from its proper issuance and registration within the Tower's legal framework. The Vitalist School, however, argues that true custodial authority inheres in the act of care itself, and that a Mandate merely records a pre-existing relationship; they point to the Gardeners of the Second Spiral, whose mandate was formally recorded only long after their establishment. This debate has practical implications for situations where a Mandate document is lost or damaged, but the custodial work continues uninterrupted.
