Clause 17(vii) of the Third Concordance

MS 1798.38 · Documents and ordinances

"The proper administration of that which has not yet been determined is the first duty of any archive." — Tract on Latent Administration

Clause 17(vii) of the Third Concordance is the foundational legal instrument governing the establishment, regulation, and dissolution of Theoretical Wings within the Tower. It is distinguished from the more general provisions of Clause VII and Clause 7 by its specific focus on provisional, non-catalogued spaces dedicated to the study of subjects whose ontological status is pending formal review. The Clause itself is paradoxically cited as both a model of bureaucratic foresight and a source of considerable administrative confusion, as its provisions are recursively applied to the Wings it authorizes.

Text and Formulation

The authorized text, held in the Vellum Originals Repository on Floor -7, reads: "Wherein a subject of inquiry is presented that possesses neither confirmed existence nor confirmed non-existence, there shall be provisionally allotted a space, to be designated a Theoretical Wing, for the purpose of its examination. Said Wing shall operate under the protocols of potentiality until such time as the Committee for Ontological Review renders a final determination, or the subject is absorbed into a neighbouring, stabilized holding." The Clause does not specify the physical dimensions of a Theoretical Wing, leading to the famous case of the Wing for Ephemeral Geometries, which occupied a volume of precisely one cubic centimetre for 312 years before being dissolved.

Operational Mechanisms

Petitioning for a Theoretical Wing is a function of the Bureau of Registry, which processes applications under the dual authority of Third Concordance, Clause VII and Clause 17(vii). Successful petitioners are granted a "Latent Charter," a document whose ink is visible only under light filtered through a prism of solidified doubt (Standard Issue, Catalogue #DV-17vii). The Wing's head researcher, titled the Provisional Curator, is vested with authority to enact "procedural realities" – temporary rules of physics and cataloguing that apply only within the Wing's boundaries. These realities are logged with the Recursive Amendments Office, often creating tangential legal entities that require their own Theoretical Wings to study, a process known as "ontological feedback."

Notable Theoretical Wings

Several Wings have achieved landmark status in Tower jurisprudence:

  • The Wing for Unwritten Concordances: Established to catalog the potential contents of Concordances that have not been, and may never be, written. It is the only Wing whose Latent Charter is written in negative space.
  • The Wing for the Sounds Between Floors: Dedicated to the analysis of ambiences, hums, and echoes that cannot be definitively assigned to any registered floor. Its findings are published in the Journal of Ambiguous Acoustics.
  • The Wing of Recursive Application: Founded to study the implications of applying Clause 17(vii) to the administration of Clause 17(vii) itself. It maintains a permanent state of "meta-provisionary" status and its budget is drawn from a theoretical account.

Contradictions and Disputes

The primary scholarly disagreement stems from the Clause's silent treatment of dissolution. While it mandates establishment "until… a final determination," it provides no mechanism for enforcing dissolution should a Committee determination never arrive, or should the subject of inquiry prove "inherently indeterminate." The Seventeenth Concordance, Clause VII attempted to address this by introducing decay protocols for Latent Charters, but this is seen by many legal formalists as an improper overreach into the domain of the Third Concordance. Consequently, numerous "zombie wings" persist in a state of permanent provisionality, their staff accruing theoretical pension benefits.

A further, more practical dispute involves spatial overlap. The Bureau of Spatial Integrity contends that a Theoretical Wing, as a provisional space, cannot occupy coordinates already claimed by a fully catalogued floor. The Guild of Scribes and Formalists, however, cites precedent where the Wing for Overlooked Details was successfully instantiated within the interstice of two filing cabinets on Floor -22, arguing that potentiality does not obey the same spatial laws as actuality.

Administrative Legacy

Clause 17(vii) is credited with creating the Tower's robust – some say bloated – infrastructure for managing the not-yet-real. It indirectly led to the formation of the Clerks of the Net Load, who are tasked with calculating the hypothetical mass and structural stress of all active Theoretical Wings upon the Tower's foundations. The Clause is also the subject of the Tract on Latent Administration, a seminal work that expands upon its principles. Despite its complexities, or perhaps because of them, Clause 17(vii) remains a critical pillar of the Tower's legal-ontological framework, ensuring that the archive is perpetually prepared for that which does not, but might one day, exist.
