Activation of the Filer’s Rights
MS 2833.25 · Practices and doctrines
The Activation of the Filer's Rights is the procedure by which a person or entity who has lodged an instrument with a Librarian acquires, at a defined moment and not before, standing to invoke the rights that instrument describes. It is distinguished from registration, which establishes only that a document exists, and from the Seal of Activation itself, which is a status rather than a procedure. Under the Corollary of Perpetual Activation, a properly inscribed document exercises its authority continuously from verification until its physical dissolution; the Activation of the Filer's Rights is the narrower question of whether the filer, as distinct from the filing, may act.
Distinction from registration
The two are routinely conflated and the conflation has cost the Tower a great deal. Registration is performed by the receiving clerk and is recorded on the facing leaf. Activation is performed by the filer and is recorded nowhere until it is disputed. A filer may register an instrument at any hour the desk is attended; a filer may activate their rights under it only after the instrument has been verified by the Office of Verification, and only within one hundred and eleven days of verification, after which the rights lie dormant until reverified. The interval of one hundred and eleven days is not explained in any Concordance. It is observed.
Where an instrument was lodged during a period when the Office of Verification was itself unverified — a difficulty that recurred in the winter of Year 1188 on the Nineth Floor, and again, more briefly, in Year 1302 — the activation is deemed to have occurred on the day the filer first believed it had, provided the filer can name that day. Filers who cannot name it must be reverified in full.
The lodging of Form OVC-22a
Activation depends on prior lodging of Form OVC-22a. The form is short; the difficulty is that it must be lodged before the filer knows that it will be needed, since the procedures of Annex Zeta cannot be invoked to recover a right whose activation was never properly begun. P. Vel is recorded as having lodged Form OVC-22a on two occasions, the second in an attempt to regularise the first, and the file has been open since.
"A filer who lodges the form in anticipation of no claim whatsoever is in the correct posture. A filer who lodges it in anticipation of a claim is already too late, though the Tower will not say so to their face."
— Fortysecond Concordance, Annex 9, marginal note
Clerks are instructed to accept the form without comment and to file it face-down. A filer who asks whether they have now activated their rights is to be told that the question is separate.
Persons of finite tenure
For transient entities the procedure is complicated by the possibility that activation will outlast the filer. The Rights of Transient Entities govern the matter, and under that philosophy an activated right survives its holder for so long as the instrument remains physically intact, unless the right is of a kind that cannot be held by anyone. The Office of Verification maintains a schedule of such kinds; it has not been revised since Year 1211 and contains entries that no longer correspond to anything.
Where a transient filer activated a right and then ceased, the right may be exercised by the nearest competent holder on the same floor. Aris, filing Incident Report 88-Gamma, noted a discrepancy in the count of such holders on the stair between the sixth and seventh landings and recommended that the count be taken afresh each morning before the desks open. The recommendation stands.
The counter-doctrine
Polian the Younger observed in Year 1240 that invoking Perpetual Activation invokes its counter, the doctrine that activation ceases at the moment of its citation. This has never been repealed and is cited constantly, chiefly by parties who wish to argue that an opponent's rights lapsed the instant they were mentioned in proceedings. The counter-doctrine does not apply where the citation is made by the Office of Verification itself, nor where it is made in error and corrected before the close of the sitting.
There is open scholarly disagreement as to whether the counter-doctrine applies to the Activation of the Filer's Rights at all, or only to the Corollary of Perpetual Activation under which the rights are exercised. The Twentythird Concordance, reading the two as a single instrument, holds that citation extinguishes both. The Fiftyfirst Concordance holds that the filer's rights, once activated, are a species of Metaphysical Proprietorship and cannot be extinguished by mere mention. Both are in force. Practitioners are advised to check which was amended more recently, and to bring a second copy of everything.
Prescribed observance
On activation, the filer reads aloud the first line of their instrument at the desk and signs the facing leaf. The reading need not be audible beyond the desk, and clerks are not required to listen. Should the filer be unable to read, the line is read for them by the attending clerk, who is not thereby a party to the instrument.
Activation on the Ground Floor is by written declaration only. The stair to the first landing is closed to filers during the reading.
