The Gavel of Deferred Judgment
MS 1130.49 · Objects and instruments
The Gavel of Deferred Judgment is an ebony striking instrument of the Chamber of Deferred Judgement, held under triple-layered Certificate of Dormancy in a velvet-lined case in the Chamber's lower vestibule, and struck only to adjourn hearings concerning dormant matters. It is the sole instrument recognised under Ordinance 712-B for creating what that ordinance calls "a legally binding pause in judgment", and its use is governed simultaneously by the Seventh Concordance and the Ninth Concordance, which disagree on nearly every point of procedure and agree only that the Gavel may not be used for anything else.
Construction and custody
The Gavel is of blackwood, 31 centimetres in length, with a head bound in tarnished brass at three points. Its striking face carries a shallow circular depression worn by use, which the Guild of Dormant Scribes records, in its standing inventory of the instrument, as "shallower than the seventh recension describes and no shallower than the ninth requires" (Guild of Dormant Scribes, Inventory Entry 4,012). The handle bears no inscription. The case bears four.
Custody rests with the Guild, which opens the case on the first working day of each quarter, records the position of the Gavel to the nearest quarter-turn, and reseals the layers. The Warden of the Silent Stroke attends these openings and signs the record; the Warden's signature is not required for the record to stand, but no record has ever been filed without it, and the Guild has twice declined to say whether this is by custom or by fear of the Ceiling of Pending Motions.
The strike and its imprints
The Gavel may be struck once per hearing. Each strike leaves a spectral imprint on the Certificate, unique to the instrument and to the hour of striking, which serves as the authentication of the deferral. The imprint fades after forty days unless the deferral has been entered in the Chamber's register, and a faded imprint is treated in law as no imprint at all. The Principle of Deferred Judgment holds that a deferral improperly authenticated is not void but merely uncommenced — a distinction the Chamber has never successfully explained to anyone outside it.
"The instrument shall be struck once, and once only, and thereafter shall be returned to its case before the hour is called. An instrument left abroad overnight is not the same instrument in the morning."
— Ninth Concordance, Annex 4
Conveners are appointed for a single term and are not permitted to practise striking beforehand. The Ordinance 712-B drafting committee considered a period of instruction and rejected it, on the ground that a rehearsed strike could not be distinguished from a genuine one by the imprint. The practical consequence is that the quality of adjournments varies with the convener, and in the winter of the fourth spiral a convener named Halvet Sarric struck the Gavel so lightly that the Chamber's clerk recorded the hearing as continuing for a further eleven months before anyone noticed.
Doctrine of deferral
Striking the Gavel instates what the Chamber calls the passive condition of Deferred Judgement: the matter is neither decided nor dismissed, and the parties are neither bound nor released. It is sometimes confused with the Deferred Holding, which operates on objects rather than matters and suspends an item's movement through archival pipelines rather than a question's movement toward answer. The two procedures share a vocabulary and nothing else, and the Class Gamma: Temporally Deferred Imperatives classification applies to neither, a point the Chamber has had to restate at intervals since the classification was introduced.
An instrument closely related in function, the Sceptre of Deferred Query, is used where the matter is a question rather than a case. The distinction is held to be obvious. It is not obvious.
The Custody Dispute
Between the Custody Dispute of the Silent Gavel's opening and its present unresolved state, the Gavel passed through a period of ritual dormancy during which the Silent Choirs claimed spiritual custodianship of the instrument, asserting that a gavel that has suspended judgment acquires a residue of the suspended matter and requires tending. The Guild of Dormant Scribes rejected the claim in a memorandum of considerable length, arguing that custodianship follows the case, not the residue, and that the Choirs were welcome to tend the residue elsewhere.
The Choirs have not been removed from the vestibule. A concordance of the period — cited variously as the eleventh or as an unnumbered schedule, depending on which recension one trusts — permitted the Choirs to sing during the quarterly openings provided they do not sing during the striking. They have kept to this. The Guild has stopped describing them as visitors.
Disputed points
The Seventh Concordance holds that the Gavel may be struck by any duly convened officer of the Chamber; the Ninth restricts the strike to the convener alone. The Seventh adds, in a clause widely believed to be a scribal intrusion, that the Gavel may also be struck in the absence of a hearing if the vestibule is empty. The Ninth does not address the vestibule at all.
Scholars of the Chamber divide on whether the requirement that the Gavel be struck "to signal" adjournment implies that the sound must be heard. The Principle is silent. The Status Alpha file on the question has been open since before the current Warden's appointment, and the Ceiling of Pending Motions has been raised twice to accommodate it. A third school, small but persistent, maintains that the Gavel's true function is not to adjourn the hearing but to inform the instrument that it has been adjourned, and that this accounts for the worn depression on its face.
The case remains sealed. It is opened four times a year, and the Gavel is turned a quarter-turn and returned.
