The Clause of Unwritten Authority
MS 1847.76 · Practices and doctrines
The Clause of Unwritten Authority is the fourth and final clause of the Precept of Unwritten Catalogues, a foundational administrative document governing the classification and handling of unwritten materials within the Tower. It establishes the principle that certain forms of institutional power exist and remain operative prior to, and independent of, their codification in written law or precedent.
Authority, in its purest form, is an unwritten quantity. It precedes the parchment that seeks to describe it and endures long after the ink has faded. To codify authority is not to create it, but merely to acknowledge its pre-existing state.
Text and Formulation
The Clause, as recorded in the Master Roll of the Gallery of Unwritten Prefaces, reads:
Let it be recognized that the capacity to compel, to order, and to adjudicate is not born of script, but is inherent in the office and the act. Any resolution, mandate, or judgment issued under the auspices of a recognized body within the Tower shall be considered to possess full authority from the moment of its conception, irrespective of the subsequent transcription or publication thereof. This authority remains in force until explicitly rescinded by a superseding unwritten instrument of equal or greater provenance.
The phrasing is notable for its use of "unwritten instrument" as the sole mechanism for revocation, creating a recursive logical structure that has been the subject of extensive commentary.
Operational Interpretation
In practice, the Clause of Unwritten Authority provides the legal underpinning for several key Tower functions:
- Provisional Mandates: Decisions made by a Librarian of the Unwritten in the field, concerning the handling of an unwritten subject, are considered immediately binding, even before a formal report is filed on an Unwritten Page.
- Force of Unwritten Precedent: The Clause is frequently cited alongside the Third Concordance, Title IV, which grants authority to Resolutions, stating they hold "the force of precedent until unwritten." Scholars debate whether the Concordance expands upon or merely restates the principle enshrined in the Clause.
- Tripartite Warrants: The authority of bodies like the Secretariat for Unwritten Protocols derives in part from the Clause, as their mandates are understood to exist prior to their often-arcane written charters.
Controversies and Scholarly Dispute
The primary controversy surrounding the Clause concerns its scope. The Librarians of the Unwritten argue for a broad interpretation, asserting that the Clause validates all unwritten knowledge and the entities described within it as inherently authoritative within their domain. This view supports their investigations into phenomena like the Paradox of the Unwritten Beast.
A more conservative school, centered in the Guild of Unwritten Precedents, holds that the Clause applies only to administrative and judicial acts, not to the ontological status of catalogued subjects. They contend that applying it to, for instance, an unwritten beast, constitutes a category error that conflates legal authority with physical existence.
A further, niche interpretation (advanced in the treatise The Unwritten Concordance Hypothesis) suggests the Clause itself is meta-textual, serving as the unwritten authority for the entire Taxonomy of Unwritten Books, thereby making the system self-justifying.
Administrative Derivation and Subordination
The Clause's influence is evident in several derived regulations. Most notably, Concordance 44, Article 5, Sub-clause γ, which subordinates the Archive of Unwritten Books to The Archive of Unwritten Prefaces, explicitly invokes the "inherent hierarchical authority" principle established by the Clause of Unwritten Authority. This has led to the current custodianship model, where the Archive of Unwritten Prefaces is jointly overseen by the Secretariat for Unwritten Protocols and the Librarians of the Unwritten.
The Clause also underpins the certification process administered by the Secretariat, whereby a Librarian of the Unwritten is certified not merely to handle special materials, but to act with the Tower's full authority in unwritten matters.
Physical Instantiations
No original manuscript of the Precept of Unwritten Catalogues is known to exist, in keeping with its subject. However, authorized copies of the Clause are held in the Vault of Unwritten Prefaces (Floor 14,303, "The Codicillary Hold"). These copies are inscribed on Unwritten Pages that have been specially treated to accept written text, a process overseen by the Secretariat for Unwritten Protocols. It is a matter of procedural irony that the definitive written form of the Clause of Unwritten Authority resides within an archive dedicated to materials defined by their lack of text.
