The Axiom of Sonic Precedent
MS 5030.11 · Practices and doctrines
The Axiom of Sonic Precedent is a governing principle of the Tower's acoustic-jurisprudential order, holding that any sound formally admitted to the record acquires the standing of a precedent and thereafter governs all subsequent utterances of its class. First propounded in the acoustic annexes of the Tome of Jurisprudential Weights and Measures and given operative force by an amendment to the Third Concordance, the Axiom establishes that a noise, once filed, does not merely persist but rules. It is distinguished from the Axiom of Precedent Reality by its subject matter — the latter concerns curated precedent generally, while the Axiom of Sonic Precedent addresses audible phenomena specifically, and holds that a recorded sound may not be contradicted by a later one of equal or lesser filing weight.
Origins and the Winter of the Lowing Corridor
The Axiom is conventionally dated to the aftermath of an incident on Floor 726 in the winter of the year recorded in the registers as 11-Post-Aperture, when a lowing sound of contested origin was heard in the eastern stair corridor for a period of nineteen days. The sound was never located, but it was logged, and once logged it could not be unlogged. When the corridor was subsequently opened to ordinary traffic, travellers reported that the lowing had resumed at intervals, though no source was found and no animal was ever entered in the floor's inventory.
The Desk of Precedential Alignment, asked to rule on whether the lowing could be struck from the record as an error, declined. Its ruling, cited in every subsequent treatment of the Axiom, held that "a sound entered in the register is no longer a sound but a finding, and findings are not struck" (Desk of Precedential Alignment, Ruling 4,411). The Librarians ratified the principle shortly afterward, and the corridor was reclassified as an established acoustic feature. It remains one. Maintenance is performed on the corridor twice yearly, and the corridor is not to be entered while it is lowing.
Relationship to Existing Sonic Doctrine
The Axiom sits at the centre of a dense body of sonic precedent. It is the authority under which Sonic Bleed Fields may be maintained past their stated decay intervals — a bleed field that has once been filed is held to bleed by right — and it supplies the reasoning behind the Doctrine of Sonic Palimpsests, which holds that a later sound recorded over an earlier one does not efface it but merely files it more deeply. The Circular of Precedent repeatedly invokes the Axiom in its recensions, though its citations disagree with themselves by the fourth recension.
Containment practice is downstream of the Axiom. Because an admitted sound acquires standing, the transport of dangerous acoustic signatures requires the sealed apparatus described at Sonic Crypt, and no crypt aperture may be opened by personnel lacking Certification in Abrupt Sonic Trauma Preparedness. The Axiom's partisans argue that this requirement follows directly from the principle: a signature that has standing cannot be casually released. Its critics argue the reverse, and at length.
"A precedent once heard is heard thereafter. The Tower does not forget a sound; it files it, and what is filed governs."
— Third Concordance, Annex 9, marginal gloss
The Valen Objection and the Question of Nonexistence
The Axiom's most persistent difficulty is its relation to the Valen Axiom, which established that nonexistence is a prerequisite for inclusion within the Tower's holdings. If a sound must not exist in order to be filed, and yet filing confers governance, then the Axiom appears to grant authority to things that never were. Clerk Theobold addressed this in his logbook entries on what he called "impressionistic solidities," which were admitted under the Axiom of Presuppositional Clarity and thereby became precedent themselves — a resolution that satisfied nearly everyone and clarified almost nothing.
Later commentary has tended to treat the objection as settled by the maxim first recorded in the marginalia of Precedent Scroll 88-C — "the filing is the founding" — on the grounds that a sound filed under the Axiom is founded by the filing and therefore exists from the moment of its admission, retroactively if necessary. Whether retroactive founding is possible remains disputed, but the dispute is conducted quietly and away from the acoustic annexes.
Scholarly Disagreement
The principal controversy concerns the Axiom's scope. The acoustic reading, favoured by the Tome's annotators, holds that the Axiom governs audible phenomena and their near neighbours — echoes, resonances, sustained tones, and the lowing already described. The broader reading, advanced in successive recensions of the Citation of Opposing Precedent and championed by the Cycle of Precedent school, holds that all precedent is fundamentally sonic, since every precedent was at some point spoken aloud in a hearing room, and that the distinction between audible and inaudible precedent is therefore an artefact of the register rather than a feature of the law.
Adherents of the broader reading point to Precedent Σ-12 and the fragmentary Precedent Γ-12/8, in which a ruling was overturned on the grounds that it had been pronounced too quietly to found anything. Adherents of the narrower reading reply that this proves only that volume matters, not that everything is sound. The Axiom of Concordant Precedence is invoked by both sides, as it usually is, and settles nothing, as it usually does.
Conditions of Application
In practice the Axiom requires that a sound be witnessed by at least two clerks, entered in the acoustic register with its measured output in sonic-affective units under the Ephemeral Gradients system, and sealed with the annex stamp of the floor on which it was heard. Sounds below the threshold of 0.4 sa.u. are recorded but do not govern. Sounds above 12 sa.u. are not recorded at all until a crypt has been summoned.
The Axiom's scope was tested most severely in the matter of Precedent Omega745 and its disputed companion entry Precedent Omega7 45, where a single sound was filed twice under two designations by two clerks working the same shift. Both filings were upheld. The sound now governs twice, and the two clerks, who have not spoken since, are each cited as authority for the proposition that the other was redundant.
