Preliminary Findings on the A-77b Contingency
MS 8404.72 · Practices and doctrines
Description
Preliminary Findings on the A-77b Contingency is a document compiled during a Preliminary Adjudication period opened under Form M-9 and filed to the registry of Contingency Measures in late YSP 991. It is most frequently cited not for its conclusions but for the dissent appended to it: an extract from the opinion of Archivist Kappa-9, recorded separately and later bound into the finding at the request of the Office of Preliminary Assessment.
The document runs to 41 folios on Vellum Grade 4, with a further nine folios of inventory tables attached under seal. Its status — whether it constitutes a determination or merely a report of one — has been the subject of two separate disputes before the Concordance authorities.
Background
A-77b was raised as an irregularity following a routine re-shelving on Floor 3,118, where an Attendant reported that a holding had been catalogued twice under two descriptions that could not both be true. The notice was filed in the ordinary way, and the finding period opened under Contingency Measures, Part IV.
The adjudication was assigned to the Office of Preliminary Verifications, which had by that winter taken to referring all contested matters to the Office of Preliminary Assessment on the grounds that its own seal had been delayed since the previous term. The delay is not explained in any surviving memorandum, though an internal note from the office clerk records that the seal was "still at the stamping" for eleven weeks.
Archivist Kappa-9 was attached to the adjudication as a consulting reviewer. The Archivist had previously been involved in the Sondergang findings and was known within the order for writing dissent at greater length than the finding itself.
Contents
The finding opens with a summary of the irregularity, followed by three sections: an inventory of affected holdings, an account of the re-shelving, and a set of preliminary conclusions. The conclusions are cautious in tone and do not, on their face, resolve the question raised by the notice. Under Ruling 88.45, this distinction is material: a "catalogued contingency" is recorded but not activated, whereas an "active contingency" triggers further measures. The A-77b finding was filed under the former heading.
The appendix of inventory tables lists 214 holdings, of which 17 are marked in the margin with an asterisk. No key to the asterisks appears anywhere in the document, and the Tome of Jurisprudential Weights and Measures does not prescribe one. Two subsequent attempts to reconstruct the key — one by the clerk Thelon, one by an unnamed scribe in the register office — produced conflicting results.
The Dissent
The extract from the dissenting opinion of Archivist Kappa-9 occupies folios 38 through 41 and is the portion most often reproduced. Kappa-9 argues that the finding, while procedurally sound, had stopped short of the conclusion its own evidence supported. The relevant passage reads:
"A contingency that has been described in full and then set down without a name is not thereby avoided. It is only postponed, and it will present itself again under another heading."
— Preliminary Findings on the A-77b Contingency, dissenting extract, folio 39
The dissent was not adopted. It was, however, cited by both parties in a later disagreement over whether the contingency had ever been activated at all, an argument that consumed most of a term in the Office of Preliminary Assessment and ended, according to the minutes, without a finding.
Subsequent history
The document was withdrawn from open reference for a period of four years following a re-shelving error that placed it among the determinations rather than the findings, an error noticed only when a reader attempted to cite it as authority and was informed by the shelf-mark that it carried none. It was returned to general reference after review.
A copy exists in the register office under a different title, and the two copies are not identical. The discrepancy has been noted in three separate inventories and has not been reconciled. It is generally assumed to be a transcription error, though no one has compared them line by line since the original scribe's term ended.
