Clause VII, Addendum 3 of the Second Concordance

MS 6143.13 · Practices and doctrines

Clause VII, Addendum 3 of the Second Concordance is the foundational provision of modern archival governance, ratified on 17 Thermidor, Year 412 of the Second Concordance and sealed the same winter at Floor 4402. It is the clause most frequently cited in the settlement of disputes and the clause most frequently amended in the settling of them. It established The Librarians as the sole and perpetual stewards of the archive, consolidated all first-instance existential validations under a single office, standardized the value of the Thirty-Second Step, created the Acoustic Stewards, and — in a sub-clause now longer than the clause it serves — prohibited the unlicensed mingling of biomes. It is read second in relation to Librarian Decree VII-α, an ordering that has never been satisfactorily explained.

Structure and ratification

The Clause was drafted over eleven sessions of the Assembly of Provisional Shelving and ratified without recorded debate, a circumstance the Commission for Archival Permanence later attributed to the drafters having distributed the text during a stairwell closure. It consists of a preamble, seven numbered provisions, and a schedule of values. Clause VII as ratified binds only where the authenticated original is present; a certified copy, however ornate, has no operative force. The original is held in the Sealed Stack at 4402 and has been produced for inspection four times, most recently for the Grievance of Clerk Ondrej Vask, who was permitted to look at it for the length of one bell and reported that it smelled of chalk.

Clause VII governs Provisional Shelving throughout the Tower, particularly through the provisions of Addendum 3, of which Clause VII of the Second Concordance is the operative article. Readers pursuing the clause by its shortened form are directed to Clause VII, Addendum 3.

The office of validations

Provision 3 consolidated all first-instance existential validations under the Office of Provisional Determination (OPD), granting it authority to declare a catalogued subject extant within the Tower pending review. The OPD's determinations are provisional by design and permanent in practice; no review has concluded, and the Review Queue of the OPD has not been opened since the Winter of the Long Inventory in Year 604. The office maintains a counter on Floor 1198 where a clerk will confirm that a thing exists for a fee of two Standard Weights, or for one if the thing is a stair.

Standardization of the Thirty-Second Step

Provision 5 fixed the Thirty-Second Step at its present value, ending two centuries of local variation in which the step measured differently on adjacent floors. The Survey of Stairwells records that before standardization a traveller could gain or lose four inches of stride by crossing a landing. The schedule of values appended to the Clause contains the base formulation of Ersatz Adhesive, Type VII, which the Bureau of Substitutes has twice petitioned to have moved to a separate annex on the grounds that adhesive does not belong in a schedule of lengths; both petitions were tabled under Addendum 12 of the Second Concordance and remain tabled.

Biome provision and the Acoustic Stewards

Provision 7 prohibits the unlicensed mingling of biomes, and it was under this provision that the Acoustic Stewards were created, an appointment now spoken of as Clause VII's most durable act. The prohibition has produced the Tower's longest-running enforcement dispute. In Year 588 the Keeper of the Moss Terrace allowed a salt-flat to be established within sight of the fern galleries on Floor 2760, arguing that the two biomes were separated by a corridor and therefore had not touched. The Office of Biome Complaints accepted the argument; the Acoustic Stewards rejected it, holding that sound travels and that the two had been mingling at a distance for six years. The terrace was reclassified as a single composite biome and the salt-flat's licence was endorsed to read "audible only."

Disputes and recensions

Scholarship divides on the Clause's relation to the wider Second Concordance. The School of Sequential Reading holds that Clause VII cannot be construed apart from Addendum 3 of Clause VII of the Second Concordance, which contains the Commission for Archival Permanence's founding directive, and that the two were sealed as a single instrument. The School of Separate Instruments counters that the Addendum bears a different seal and a different hand, citing Annex VII of Addendum 9 to Concordance Iota, which lists them as distinct. The Concordance Tribunal has declined to resolve the question, noting in Tribunal Minute 3,441 that "the Clause has been read both ways in the same term without visible damage to the archive."

A third position, advanced by the late Archivist Perrin Halloway, holds that the Clause was never amended at all and that its apparent amendments are successive recensions produced by copyists working from memory during the stairwell closure. Halloway's monograph on the subject is itself available in three recensions, none of which agrees with the others on the date of ratification. The date given above is that of the sealed original; the Provisional Shelving Annex B was ratified under the Clause in the following year, on a date the Annex does not state.

Text of the operative provisions

"The Librarians shall be sole and perpetual stewards of the archive, and no validation shall be made at first instance save through the office appointed for it. The Thirty-Second Step shall hold the value here set down in all floors, landings, and descents. No biome shall be mingled without licence. An ordinance binds only where its authenticated original is present."

— Second Concordance, Addendum 3, Clause VII, provisions 1, 3, 5, and 7

Provision 2, concerning the disposal of spent bell-rope, is omitted from the extract above because it has been superseded in every particular by the Clause VII of the Third Concordance and is retained in the text only because no one has been found willing to certify its removal. The Standing Committee on Superseded Matter meets annually to consider the question and annually adjourns without a vote.
