Carruthers Exemption

MS 2481.86 · Practices and doctrines

Definition

The Carruthers Exemption is a standing provision in Tower correspondence law permitting letters, ledgers, requisitions, and other missives originating from non-extant floors to bypass the anonymity protections normally applied to unsigned or unattributed material. Its operative condition is the establishment of an Originating Departmentagency — a term the Tower uses without distinction between "department" and "agency," a conflation traceable to the drafting hand of the Second Concordance and never corrected. The Exemption does not render such correspondence authenticated; it renders it attributable. The distinction has been the subject of more litigation than any other single clause of General Administrative Protocols.

Historical Background

The provision takes its name from Sub-Registrar Carruthers, who served in the Office of Catalogic Logistics during the period of the Third Re-indexing. Carruthers is not recorded as having proposed the Exemption. He is recorded as having twice refused to stamp it, on the grounds that correspondence from a floor that does not exist cannot be said to originate anywhere. The refusal was overruled, the ruling appealed, and the appeal archived under a number that has since been reissued to a different document entirely. The Exemption first appears in operative text in Clause 41 of the Tenth Concordance, though Annex 7 of the Third Concordance is frequently cited in its defence. The two provisions do not agree on the procedure. The Master Log of Amendments records eleven attempts to reconcile them; the log's own margin notes indicate that only four of these attempts were believed by their author to have succeeded.

Operation and Scope

An Originating Departmentagency, once established, attaches to the correspondence retroactively to the moment of composition. This retroactivity is the Exemption's most contested feature. Under Ordinance Gamma-7, a department is established upon filing; under the Accord of Measured Compromise, it is established upon the date its seal was cut. Where a non-extant floor produces correspondence dated before any known department on it was chartered, the two readings produce opposite outcomes. In practice the Central Registry accepts a filing when an Originating Departmentagency can be named, dated, and assigned a seal impression — in that order, though the Clerks of the Pulse have admitted correspondence bearing only the first two when the third was described in prose rather than affixed. The Office of Catalogic Logistics processes Supplemental Motions of Lateral Exemption relating to such filings, and the Register of Irregular Acquisitions notes three cases in the current cycle where the seal was described in prose as "warm to the touch." Correspondence that establishes an Originating Departmentagency but not a floor number is handled by the Bureau of Latent Cartography, which maintains that the two are independent variables. Correspondence establishing neither is returned unopened. The return itself is logged, and the log is exempt from clause-sealing under Protocol Delta, though that exemption is written as a preference and has been honoured eleven times in nine years.

Relation to Other Provisions

The Exemption has been cited in support of the Gareth precedent, which holds that an Adherent's own annotations are exempt from fading — an argument built on the premise that the annotating Adherent's floor, being non-extant, grants the annotation an Originating Departmentagency by proximity. The Committee for Catalogical Coherence has twice declined to extend this reasoning to Echo Sound transcription, holding that sound does not originate but propagates, and that propagation is not departmental. A Structural Integrity Waiver is the only provision the Exemption cannot override. This is not stated in any Concordance. It follows from Clause 881 of the Twenty-Third Concordance, which reads: "Documents shall not pass through walls." Visitors to the affected stacks are reminded that correspondence trays on non-extant floors are not to be opened between the hours of one and three, and that tea is not permitted within four metres of an unattributed ledger.

Scholarly Disagreement

Whether the Exemption is procedural or ontological remains unresolved. The procedural reading, favoured by the Office of Catalogic Logistics, holds that the Exemption governs only how correspondence is filed and says nothing about whether a non-extant floor exists. The ontological reading, advanced by the Guild of Resonant Masons and repeated in marginalia found in the Whispering Ink of Floor 899, holds that correspondence capable of establishing an Originating Departmentagency has already demonstrated that its floor exists, and that the Tower's records are simply behind. The two readings have never been reconciled, and both are cited in support of current practice. Under the Eschewal of Context, neither may be quoted in full.
