Tower Law

MS 6181.11 · Practices and doctrines

Tower Law is the comprehensive system of formal governance and jurisprudence that regulates all official conduct, classification, and ontological arbitration within The Tower. It is distinct from, yet fundamentally derived from, Concordant Law, with the primary distinction being one of scope and function: while Concordant Law constitutes the written statutes and amendments, Tower Law encompasses their application, interpretation, and the procedural mechanisms that give them force.

Composition and Sources

Tower Law is not codified in a single document but is an emergent system built from multiple, often conflicting, sources. Its primary constituent is the active corpus of Concordant Law, as maintained by the Central Registry of Codified Law. Secondary sources include the ratified precedents of the Librarians' Tribunal, the operational charters of recognized Guilds of the Tower, and the body of Declarations of Clarification issued by the Board of Concordant Interpretation. A tertiary, but persistently influential, stratum consists of unwritten customs, procedural norms of the Central Registry of Precedents, and the doctrinal commentaries of senior Librarians. The inherent contradictions between these sources are not considered flaws but are the engine of legal refinement, resolved through the principle of Proximate Authority.

Foundational Axioms

The ontological foundations of Tower Law were formally established by Concordance 44, Amendment 12. Two axioms are considered inviolable:

  1. The authority of the Tower's governance is coextensive with its physical structure and the contents catalogued therein.
  2. Any entity, concept, or event catalogued within the Tower is granted provisional reality for the purposes of legal and administrative procedure, irrespective of its external ontological status. This is often summarized as "Catalogued, therefore actionable."

These axioms allow for the prosecution of offenses involving hypothetical creatures, the granting of permits for accesses to non-existent apertures, and the legal recognition of events documented in classified holdings that are themselves classified as "ontologically indeterminate."

Enforcement and Adjudication

Primary enforcement authority rests with the Obsidian Guard, whose mandate is defined by the Seventeenth Concordance. Their jurisdiction is limited to matters of physical security, containment breaches, and the enforcement of Tribunal writs. Adjudication of disputes under Tower Law occurs through two primary channels: administrative rulings by relevant Guild arbiters (for internal guild matters or classification disputes), and formal legal proceedings before the Librarians' Tribunal for inter-guild conflicts, challenges to Concordances, or crimes against the epistemic integrity of the Tower. All Tribunal rulings are subject to Concordant Verification before being logged as binding precedent.

The Ephemeral Gradients System

A key procedural component of Tower Law is the system of Ephemeral Gradients, integrated by the Nineteenth Concordance. This system provides a standardized metric for weighing the evidentiary value of documents based on their "existential density"—a measure derived from citational recursion, cross-floor corroboration, and archival stability. A manifest from a stable, well-trafficked floor may have a high Gradient, granting it substantial weight in a property dispute, while a solitary, uncorroborated ledger entry from a decaying sub-stack may have a near-zero Gradient, rendering it legally ephemeral. The application of Gradient thresholds is a common point of contention in Tribunal cases.

Notable Contradictions and Disputes

Scholarly debate within Tower Law is perpetual. A central unresolved contradiction lies between the principle of "citational primacy" upheld by the Central Registry of Codified Law and the "doctrine of manifested intent" favored by several Guilds. The former holds that the legally binding fact is the one with the oldest or most heavily cited entry in the Central Registry, even if later discoveries contradict it. The latter argues that the intent behind the cataloguing act—inferred from marginalia, filing system choice, or the original Librarian's known proclivities—should hold sway. This debate was most famously highlighted in the case In re: The Phantom Catalogue of the Aperture of Absolute North, which remains cited by both sides.

Furthermore, the legal status of amendments that directly contradict the foundational axioms remains untested, as no Tribunal has been petitioned to rule on a Series Ω edict that explicitly negates Axiom Two, creating a latent constitutional crisis that is the subject of extensive speculative commentary but no actionable case law.

Relationship to Concordant Law

While often used interchangeably in casual discourse, Tower Law and Concordant Law maintain a formal distinction. Concordant Law is the written letter—the specific clauses, amendments, and ratified texts. Tower Law is the living practice—the intersection of those texts with precedent, procedure, enforcement, and the Tower's unique ontological constraints. One cannot practice Tower Law without referencing Concordant Law, but one can recite Concordant Law without engaging with the complex, often contradictory, system of Tower Law that gives it operational meaning within the endless archive.
