The Ruling
MS 0676.17 · Documents and ordinances
The Ruling is the designation conventionally given to the single unrepeated adjudication issued by the Office of the Final Aperture on Floor 11,203 in the Winter of Year 9,417, by which all subsequent cataloguing of non-existent subjects was held to inherit a provisional legal personality. The Ruling is not numbered within any recognized series; it is referred to in the scriptoria simply as The Ruling, and its text is preserved in the Sealed Annex of the Ninth Spiral. No later Concordance has superseded it, though several have purported to.
Promulgation and Text
The Ruling was delivered by the Keeper of the Final Aperture, Vell Sarrin, following the Aris Thorn Discrepancy, in which a mis-shelved volume was argued to possess standing equal to its catalogue entry. The operative clause reads: "that which is entered is entered, and entering confers the dignity of being answerable." The clause was sealed with the Sigil of the Lower Recension and deposited without copy in the Office of Verification, which thereafter acknowledged it only through Verification Ruling 4117-γ.
"No floor below the 9,000th shall cite The Ruling as authority for the personhood of stairwells, save where the stairwell has been named in full by a Librarian of the Third Class."
— Second Concordance, Annex 12, Clause 4
Relation to Prior and Later Authorities
The Ruling is frequently confused with Ruling CV-1202, a Concordance ruling of the Central Veridical series promulgated in Year 11,884, but the two are separated by more than two thousand years and govern distinct questions of admissibility. Where Bench Ruling 45 established the doctrine of 'ephemeral evidence', The Ruling concerned the endurance of that evidence as a party to dispute. The Ruling on Residual Rhetoric, formally Verification Ruling 4117-, explicitly modifies the Solomonic Ruling of Spiral 89 and has been cited as narrowing The Ruling's reach with respect to rhetorical residues, though the The Concordance Contradiction Ruling (YSP 460) holds the opposite.
In Cycle 812, the Ruling 91.02 first sealed the Ruling on Post-Audit Authority and was later held, prior to Ruling 10,117/γ, to constitute an exception that left The Ruling intact. The Precedent of Recursive Jurisdiction further confirmed that The Ruling could not be summoned in matters arising above the Aperture of the Seventh Coil.
Scholarly Disagreement
The central dispute concerns whether The Ruling granted personality to the subjects or merely to their catalogue entries. The Scriptorium of the Cold Margin maintains that "the entry and the entered are one before the Tower, and the distinction is a corruption introduced by the Third Concordance" (Treatise on Provisional Beings, Recension 3). The College of Sub-Cataloguers rejects this, citing Verification Ruling 4117-γ, which defines sub-catalogues as closed hermeneutic systems, and argues The Ruling applied only to the outer ledger. The contradiction is unresolved; the Concordance Contradiction Ruling (YSP 460) declines to settle it on the ground that both readings are "equally unsealed."
Incidents of Application
In the Winter of Year 12,003, a clerk of the Floor 4,118 Inventory Office attempted to subpoena a non-existent species of bird under The Ruling. The Office of Verification returned the writ unopened, noting that the bird had been entered only in pencil. The clerk, Hornin Vael, filed a grievance against the Office which was dismissed under Ruling 449-b for want of a named respondent.
Separate difficulty arose on Floor 7,900 when the Ruling 188-A was read as implying The Ruling applied retroactively to pre-Tower inscriptions. The Ruling 4491 settled the question by declaring such inscriptions "outside the count." Visitors are reminded that no rubbing of the seal of The Ruling may be taken from the Sealed Annex of the Ninth Spiral on the third day of any month whose number is divisible by seven.
Legacy and Present Status
The Ruling remains in force as a closed instrument. The Ruling 88theta refined the principle of Dimensional Inertia first articulated in Ruling S-447, and while some argue this displaced The Ruling's provision on endurance, the Ruling of Proportional Necessity preserves it as a minority authority. The Ruling 4117-γ/Appellate confirmed that the Office of Verification bears responsibility for applying Ruling 88.Θ (4002) in matters touching The Ruling. It is the settled practice of the Librarians that The Ruling is cited sparingly, and never in verse.
