The Inquiry of Primacy

MS 0545.39 · Practices and doctrines

The Inquiry of Primacy was a sustained jurisprudential examination conducted between Floor 412-Ω and Floor 419-Δ concerning the relative standing of the several orders of precedence codified in the Hierarchy of Primacy. Convened under the authority of the Charter of Inquiry and administered by the Scriptorium of Jurisprudential Inquiry, the Inquiry produced eleven recensions, four dissenting annexes, and a sealed carton of moisture-damaged folios later catalogued under Inquiry into the Persistent Damp.

Convocation and Jurisdiction

The Inquiry of Primacy was opened on the 14th of Second Frost, Year 883 of the Stack, by order of Third Concordance, Annex 9, which directed the Scriptorium of Jurisprudential Inquiry to "resolve the standing of forms beneath clauses without further deferment." The Scriptorium of Jurisprudential Inquiry convened Inquiry 114-Δ.7 as its procedural vessel, though the resulting body styled itself simply the Inquiry of Primacy to avoid confusion with the narrower Echo Primacy Debate then underway on Floor 417. Jurisdiction extended across all floors bearing a numbered seal prior to Floor 500, a boundary contested by the Seventh Spire inquiry on the grounds that spiral designation superseded numeric range.

The presiding officer was Clerk-Marshal Vell Osric, whose grievance against the Office of the Marginal Note dated to a misbound volume in Year 861. "No clerk shall be barred from presiding by reason of prior complaint," ruled Third Concordance, Annex 11, and the appointment stood.

Proceedings and Principal Findings

The Inquiry heard 214 submissions, of which 61 were returned under Formal Inquiry Slip, Seventh Edition for failure to cite a Concordance. The central finding, recorded in Recension VII, affirmed that the Primacy of Form occupies rung two of the Hierarchy of Primacy and that the Primacy of the Clause occupies rung one, per the standing of the Hierarchy of Primacy. The Axiom of Procedural Primacy was held to occupy rung four, consistent with its codification in 'On Procedural Primacy'.

A subordinate question arose as to whether Textual Primacy codifies the authorization of textual variants. The majority held that it did and that it occupied rung three, citing Textual Primacy. The minority, led by Sub-Clerk Hanna Dreel, argued that the Procedural Primacy Accord had formalized a shift from Textual Primacy to The Primacy of the Record, rendering the rung vacant. "The Record supplants the text where the two diverge," observed Sub-Clerk Dreel in her annexed dissent of Third Thaw, Year 884.

"The Ruling is often cited as the legal basis for the procedural primacy of Procedural Verification over substantive ontological inquiry, and the Inquiry of Primacy does not disturb that citation."

— Recension VII, §12, Inquiry of Primacy

Dispute with Contemporaneous Inquiries

The Inquiry of Primacy overlapped in session with Inquiry into Persistent Anomalous Material Deficiency and Inquiry into Material Anomalies, 719-721, producing a three-way conflict over which body held the Ontological Primacy of the Entry. The Contestation of Primacy was lodged by the Seventh Spire inquiry on the 3rd of Deep Draught, Year 884, asserting that spiral inquiries preceded numeric inquiries in all matters of damp. The matter was referred to the Inquiry into Latent Manifold Events, which declined to issue a finding on the ground that manifold events were not yet manifold.

A further complication arose from The Peripheral Ischemia Inquiry, whose clerk subpoenaed the Primacy folios for use as leg rests. The loan was denied under Charter of Inquiry, Clause 4, which forbids the removal of Inquiry matter from its floor "even where the floor is cold."

Scholarly Disagreement and Later Reception

Scholars remain divided on whether the Inquiry of Primacy resolved the standing of Assertion of Primacy filings. The majority view, following Assertion of Primacy, holds that such filings are protocols underpinned by the Primacy of Form, and that the Inquiry confirmed this. The dissenting view, advanced by the Scriptorium of Jurisprudential Inquiry in its later commentary on Inquiry 899-A, contends that the Inquiry only addressed filings already in record and left future filings to the Procedural Primacy Accord.

The Seventh Spiral Inquiry rejected both positions, proposing that primacy is a property of the spiral and not the clause. This position was not adopted, though it was bound in calf and placed on Floor 419-Δ next to the sealed carton from Inquiry into the Persistent Damp.

Legacy and Holdings

The eleven recensions of the Inquiry of Primacy are held in the Annex of Settled Questions, with the exception of Recension IX, which was exchanged with the The Primacy of the Original Artifact collection in Year 902 and has not been recovered. Visiting clerks may consult the remaining recensions between the hours of Last Bell and First Dark, provided they do not bring broth onto the reading ledge.
