Precedent Σ-45/2
MS 6652.38 · Practices and doctrines
Precedent Σ-45/2 is a Standing Precedent concerning the epistemological status of archival cross-references. Formally titled "On the Binding Nature of Inter-Floor Citations," it asserts that a citation to a non-existent holding, once recorded in an official register, creates a binding obligation for the Tower to realize the cited content. Its adoption precipitated the Six-Year Silence and remains one of the most contentious rulings in the Judicial Precedent corpus.
Textual Provisions
Ratified on 17 Heptameron, 712 (Post-Calibration), the Precedent consists of a primary clause and three interpretive annexes. The operative clause reads:
Any citation, duly entered into a Master Concordance or its affiliated indices, which references a holding, floor, or entity not presently catalogued within the Tower’s verifiable bounds, shall be considered a pre-figurative mandate. The administrative apparatus is thereafter obligated to manifest, locate, or otherwise instantiate the cited subject, with the citation itself serving as the foundational proof of its necessary existence.
Annex A clarifies that "verifiable bounds" refers to the surveyed extents documented in the Census of Verified Floors, excluding speculative or expeditionary reports. Annex B outlines the procedure for filing a "Citation Realization Request" with the Precedent Register. Annex C, often called the "Silence Protocol," stipulates that if realization fails within a six-year period, the citing document must be placed under a moratorium of access and commentary.
Administrative Impact
The immediate effect of Precedent Σ-45/2 was a massive bureaucratic backlog. The Indexing Guild reported that, in the month following ratification, over 12,000 "pre-figurative mandates" were generated from cross-references to hypothetical floors (e.g., The Floor of Whispering Statues, The Amber Crypt) and speculative documents (e.g., The Eleventh Concordance, Precedent Zeta-1). The Judicial Precedent Guild was tasked with realization, an effort that consumed significant resources and led to the establishment of the Department of Proleptic Archives.
The Precedent is frequently contrasted with Precedent Ω-7/45, which deals with the harmonization of existing contradictory records. Scholars note that while Ω-7/45 is a tool for reconciliation, Σ-45/2 is a mechanism for generative obligation, creating new administrative reality from archival lacunae.
The Six-Year Silence
When the first major wave of realization deadlines began to expire in 718 P.C., the moratorium protocol of Annex C was triggered. This resulted in the temporary sealing of entire wings of the Hall of Administrative Precedent, including the seminal Whispering Corridor rulings and hundreds of Circulars of Precedent. This period, known as the Six-Year Silence, saw a significant reduction in legal scholarship and a reliance on oral tradition among junior librarians. The Silence was not fully lifted until the Counter-Precedent Γ-12/8 was issued, which created a system of "citation escrow" for unrealized mandates.
Doctrinal Disputes
The philosophical underpinning of Σ-45/2 is a direct extension of The Axiom of Precedent Reality, but its application remains hotly debated. The Literalist School argues that the Precedent is a necessary bulwark against referential collapse, ensuring the Tower’s internal consistency. The Instrumentalist School, however, views it as a catastrophic conflation of reference with reality, famously quipping that "the map is not the territory, but the Tower now must build the territory to match the map’s errors."
A further practical dispute concerns recursive citations. If Document A cites non-existent Document B, and Document B, upon its eventual realization, cites non-existent Document C, does the original mandate from A extend to C? A 721 P.C. ruling by the Court of Unseen Precedents held that it does not, but dissenting opinions noted this creates a "fractured lineage" of obligation.
Current Status
While never formally superseded, Precedent Σ-45/2’s most stringent effects have been mitigated by Precedent Γ-12/8 and subsequent rulings from the Precedent Register. Its principles, however, are still invoked in cases of severe referential drift, particularly in the lower, less-charted floors. It stands as a permanent testament to the Tower’s struggle to administrate not only what is, but also what its records insist must be.
