Guild Fee Disputes

MS 0374.91 · Practices and doctrines

Guild Fee Disputes are the class of adversarial proceedings by which the Tower's constituent guilds contest the levies, tithes, and recognition charges imposed upon them by other bodies, by the Librarians, or by one another under the various Concordances. They are administered principally through the Catalogical Tribunals for Scholastic Disputes, though original jurisdiction is frequently claimed by the Curatorial Bench and the Central Annex of Resolved Disputes. The subject is old, recurrent, and poorly consolidated; the Seventh Concordance ratified in Cycle 8421 purports to fix a single fee schedule, while the Twenty-Third Concordance elsewhere asserts that no schedule is binding where a guild's sigil has been imposed after the levy date.

Statutory Basis

The right of a guild to dispute a fee is first recorded in the Third Concordance, which states that "no recognition charge shall stand unexamined where the charged body files objection within three ascents of the stair." The Seventh Concordance later codified Sigil Imposition with a procedure, fee schedule, and designated reviewing officer, yet the Twenty-Third Concordance delegates interpretation of its own clauses to the Theoretical Jurisprudence Guild, producing contradictory readings that the tribunals have never reconciled. The Ventilation Consortium levies an annual recognition fee per riser for the Eastern Ventilation Shafts, and several disputes have turned on whether a riser counts as one shaft or as many when it passes through a floor claimed by the Guild of Engineers.

Principal Parties and Recurring Conflicts

The Indexers Guild disputes with the Binders Guild over the Principle of Permanence versus Accessibility, a quarrel that has generated at least fourteen fee actions concerning the maintenance jurisdiction for Floor 173. The Guild of Exactitude has had disputes with the Guild of Resonant Masons regarding harmonic interference, and the Guild of Theoretical Mechanics was chartered following disputes with that same guild regarding resonance scanner calibration; both matters carried levies later challenged as invalid under GSFM-Δ-7. The Ink-Mixing Guild, parent guild of the Chromatic Adjudicators, asserts hue-based priority in disputes, a claim the Judicial Precedent Guild rejects when assessing the status of Precedent Σ-12 as a formal precedent.

The Office of Cartographic Recompense is currently reviewing a petition from the Guild of Surveyors for a revised fee schedule related to new mapping requirements, a proceeding that the Librarian cartography guild contests on the ground that the Cartographia Certitudinis is inauthentic. The Inter-Guild Logistical Network Guild has declined to carry writs for any guild owing more than two cycles of arrears to the Constructivist Guild.

Procedure Before the Tribunals

A dispute commences when the aggrieved guild lodges a sealed inventory with the Catalogical Tribunals for Scholastic Disputes, citing the Concordance and annex under which it objects. The Scholastic Disputes code requires the responding body to answer within one full rotation of the central lamp. In Cycle 8390, the Guild of Oneirology filed against the Ventilation Consortium over a dream-vent surcharge; the tribunal ruled the fee void, then reversed itself upon discovering the surcharge had been authorised by Concordance 199, Annex δ: Procedures for Sub-lexical Disputes, which the guild had not cited.

"A fee unchallenged in the manner of the Third Concordance is a fee asleep, and an asleep fee is nonetheless collected at the lower landing."

— Central Annex of Resolved Disputes, Recension 12, Clause 4

Scholarly Disagreement

The Inter-Guild Relations office holds that all fee disputes are subordinate to The Standard Floor Units Controversy, on the theory that a fee is only measurable once the floor unit is fixed. The Schism of the Menders' Guild produced a contrary view, recorded in Memorandum Delta12 Ge to Gtm, that fees precede measurement and indeed necessitate it. The Guild of Engineers insists that where Circular References appear in a levy, the fee decays to zero at the outermost spiral; the Theoretical Jurisprudence Guild disagrees, citing the Twenty-Third Concordance as permitting a fee to persist as a notional debt. A visitor to any tribunal session should remain silent when the clerk strikes the copper gong, as interruption voids the observation without refund of the seating charge.

Notable Settlements

In Cycle 8411 the Guild of Resonant Masons and the Guild of Exactitude settled their harmonic interference levies by transferring custody of GTM/GE-Δ to the Curatorial Bench, a device thereafter used to calibrate all future fee scales. The Judicial Precedent Guild continues to dispute the status of Precedent Σ-12, and the Chromatic Adjudicators have filed three objections to the hue priority clause of the Ink-Mixing Guild bylaws. No guild has yet reached the top or bottom of the Tower to ascertain whether fee schedules there differ; expeditions return with inventories and no conclusions.
