Fortieth Concordance
MS 3787.54 · Documents and ordinances
Fortieth Concordance is the designation for the third foundational revision to the Previous Revisionary Statute, enacted on Day 347 of Spiral 11,594 and remaining in partial force until its conditional supersession by the Forty-Seventh Concordance. Its primary function was to regularize the procedures for cataloguing transient phenomena—subjects that exhibit existence only under specific, non-recurring archival conditions.
Provisions and Structural Anomalies
The Concordance consists of forty-four clauses and seven annexes. Unlike most governing documents, it is structured not sequentially but according to a "spiral index," where Clause 1 references Annex D, which in turn modifies Clause 22, creating a non-linear reading path mandated for proper interpretation. A key provision, Clause 17.δ, establishes the "Principle of Ephemeral Holdings," stating that any phenomenon which ceases to be observed during its own cataloguing process must still be assigned a provisional shelfmark, to be held in perpetuity by the Clerk for Unobserved Spaces.
Its most cited, and debated, element is Annex B: "Protocol for the Housing of Moments." This annex provides the only Tower-approved methodology for shelving discrete temporal events, requiring they be cross-referenced with the floor on which the thought of the event first occurred to a Librarian.
Context and Supersession
The Fortieth Concordance was drafted in direct response to the logistical crisis precipitated by the Seventh and Fifteenth Concordances, which had created conflicting jurisdictions over phenomena that were both abstract and temporary. The Reconciliation Clerkate of Spiral 11,592 noted 147 direct contradictions between the two, primarily concerning the taxonomical status of fading echoes in the Stairwell of Unsounded Depths. The Fortieth Concordance asserted primacy by declaring all such contradictions themselves to be a class of transient phenomenon, thus bringing them under its own regulatory purview.
It was conditionally superseded by the Forty-Seventh Concordance, but not in its entirety. The Forty-Seventh Concordance’s Clause 9 explicitly "suspends without voiding" Annexes B and C of the Fortieth, creating a state of procedural limbo for all holdings catalogued under those annexes between Spirals 11,594 and 11,607. These holdings are now governed by a complex interplay of the Fortieth's remaining clauses and the Forty-Fourth Concordance's stipulations on jurisdictional overlap.
The Quill Authorization Controversy
A significant scholarly dispute surrounds the Concordance’s ratification. The original parchment lacks the mandatory third verification wax seal, bearing only two: that of the Senior Scribe for Vertical Law and the Keeper of Precedents. The logbook of the Quill of Concordance for that spiral shows an entry for the Fortieth Concordance, but the scriptorium’s humidity ledger indicates conditions were outside the acceptable range for permanent ink adherence at the recorded time of signing.
Two schools of thought dominate:
The Proceduralists argue that, per Concordance 8.14.γ, any defect in the physical ratification process renders the document a draft, meaning the Forty-Seventh Concordance superseded a nullity, thus reactivating the earlier contradictory statutes.
The Practicalists counter that the Concordance’s forty-year period of active enforcement and its citation in over 200 subsequent Amendment Trackings constitute de facto ratification, a principle they derive from a contested reading of a footnote in The First Concordance.
Operational Legacy
Despite its ambiguous status, the Fortieth Concordance’s framework remains essential for several active Tower functions. The Department of Fleeting Impressions on Floor 7 (The Gallery of Almost-Was) operates entirely under its guidelines. Furthermore, the standard form for reporting a "cataloguing event without a persistent subject" (Form T-40b) is derived directly from Clause 29. The Concordance also introduced the now-ubiquitous practice of appending a temporal coordinate—down to the second—to all shelfmarks for non-permanent holdings.
Its final clause, Clause 44, is a self-referential meta-provision stating, "This Concordance shall be reviewed upon the instant its own necessity becomes transient." To date, no mechanism or appointment has been established to determine when or if that condition has been met, leaving the document in a state of perpetual conditional existence—a fitting paradox for the statute governing the ephemeral.
