Form 44-A: "Notice of Persistent Aperture"
MS 3907.28 · Documents and ordinances
Form 44-A: "Notice of Persistent Aperture" is the standard instrument by which a standing opening in the fabric of a floor is declared, registered, and permitted to remain. It is filed in triplicate with the Clerks of the Aperture, who retain the first and third copies and return the second to the filer stamped, folded, and — by standing instruction — unread. The form is among the oldest in continuous use, predating the Concordance of Open Doors that now governs it, and is the only instrument in the Tower's registers whose submission is itself evidence of the condition it describes.
The form records four particulars: the location of the aperture by floor number and nearest stairwell; the date of first appearance; the date of third failed attempt to secure a vacancy at the aperture; and a brief attestation that the opening does not lead anywhere that can be entered. Filers are reminded that the fourth particular is not optional. The Registry Form 44-ψ for incongruent fact was created largely to handle the disputes that arise when it is omitted.
Origin and the Question of the Third Attempt
Form 44-A was promulgated under the Second Concordance, Article 12, which fixed the threshold for an aperture's registration at three failed attempts to secure a vacancy rather than two or four. The choice of three was not argued in the record. The compilers of the Third Concordance later claimed the threshold was always "three, or such number as the Aperture perceives as three" (Third Concordance, Annex 9, marginalia), a phrase that has never been reconciled with Article 12 and is cited only by filers seeking to bypass the requirement altogether.
The practical consequence is that a filer must approach the aperture three times, each time attempting to secure a vacancy, and must document each attempt. Attempts made in the same hour count as one. Attempts made by the same clerk on consecutive days count separately, a ruling of the Clerk-Registrar Osper Vane (Recess 11,441) that has been appealed four times and upheld four times.
Filing Procedure and the Triplicate
Submission is in triplicate. The first copy is sealed into the Aperture Ledger and may be consulted only by holders of a Notice of Accessions in good standing. The third copy is filed by floor number, a practice that has produced the archive's characteristic disorder, since the numbers are not sequential in any way anyone has been able to reconstruct. The second copy is returned to the filer and is, in the words of Clerk Mira Feld, "the property of the filing clerk, and the burden of the filing clerk, and no one else's" (Feld, Marginal Notes on the Aperture Ledger, folio 14).
"The second copy is retained by the filer. It is not to be read aloud on any floor above 3,000. It is not to be folded along the seal."
— Concordance of Open Doors, Annex 4
The prohibition on folding along the seal is enforced by the Clerks of the Aperture without exception. The prohibition on reading aloud is not enforced at all, and a 12,880 dispute over whether an unenforced prohibition is a prohibition remains open before the Bureau of Contested Interpretation.
Amendment History
The form has been amended eleven times since its promulgation. The first six amendments concerned spacing. The seventh, under the Fourth Concordance, added the attestation clause. The eighth removed the attestation clause and restored it in a footnote. The ninth, in the winter of 8,902, moved the footnote to the reverse of the third copy, where it could not be read without unfolding the seal — a change that was itself held to violate Annex 4 and precipitated the resignation of two Clerks of the Aperture, both of whom later returned.
The eleventh and current recension requires filers to append a CXR-1 where the aperture is situated within four strides of a registered cross-reference. Where it is situated within two strides, a Notice of Scheduled Dimming must also be appended for the duration of the window, together with a Form 447-A: Notice of Unattainable Resource if the dimming cannot be scheduled.
Interaction with Adjacent Instruments
Form 44-A is frequently filed alongside the Notice of Expressed Intent, though the two serve opposite purposes: the intent is declared in advance, the aperture is declared after the fact. Where a filer has submitted a Notice of Intent for Direct Observation in respect of the same aperture, the 44-A is held in abeyance until the observation concludes or is abandoned, whichever is later. In practice most observations are abandoned, and the 44-A is then registered retroactively to the date of the original filing, with the resulting retrospectively dated seal, which the Aperture Ledger accepts and the stairwell clerks do not.
Failure to file does not cause the aperture to close. It causes the aperture to be listed as unregistered, which the Concordance of Open Doors treats as a defect of the record rather than of the floor.
The Feld Objection
In 9,014 Clerk Mira Feld objected that Form 44-A did nothing. The aperture, she wrote, persisted whether or not the form was filed; the triplicate changed no measurement and closed no opening; the Clerks of the Aperture had never been observed at an aperture. Her objection was recorded, circulated, and answered in the customary manner, by the issuance of a Notice of Contradictory Certification confirming that the form was both necessary and without effect, which resolved the matter to the satisfaction of the issuing office. Feld's marginal notes remain in the Aperture Ledger and are consulted more often than the forms they annotate.
Filers are reminded that the second copy must be kept dry.
