Clause 31, Annex Gamma

MS 3566.41 · Documents and ordinances

Clause 31, Annex Gamma is the provision of the Third Concordance governing the standing room of the Annex itself — that is, the aggregate volume on each Annex Gamma floor that may be occupied by persons, instruments, and accumulated paper at any one time without the floor's designation being subject to review. It is among the shortest clauses in the Concordance and among the most litigated. The prevailing text runs to forty-one words and has been amended nineteen times, chiefly in respect of the word persons.

Text and recension

Clause 31 as currently enforced reads:

"No floor of Annex Gamma shall be held to exceed its standing room where the occupied volume remains below that recorded in the Schedule of Measured Postures, save that instruments of observation are counted twice and their operators not at all."

— Third Concordance, Annex Gamma, Clause 31

The Schedule of Measured Postures, appended in the seventh recension, tabulates the volumes occupied by clerks standing, clerks seated, clerks seated with ledgers open, and clerks in the act of ascending. It contains no entry for kneeling, a gap that produced the whole of the Clause 11 dispute and which the Librarians have declined to close on the grounds that a closed schedule invites litigation about its edges whereas an open one merely invites litigation.

The counting of instruments

The double-counting of instruments was introduced by the Tenth Concordance, which first codified Clause 22, Annex Gamma, on the reasoning that a theodolite occupies its own footprint and additionally obliges its operator to stand further back than they otherwise would. Operators, being thus displaced, were ruled to occupy no volume at all. The Measurer Scribes for Annex Gamma 7 have twice petitioned against this arrangement, observing that they are themselves instruments of measurement under the Schedule and therefore counted twice, and not at all, in the same reckoning.

The petition was referred to the Central Vault of Annex Gamma and has not returned. The Scribes continue to work the seventh floor in the interval.

Dispute with Clause 18

Clause 31 is held by some recensors to be void where the Third Concordance's Clause 18, Annex Gamma establishes the formal parameters of Occlusion. The argument, advanced at length by the recensor Vell in the winter of the ninth Archival Cycle, is that an occluded subject occupies the volume of its occlusion rather than of its body, and that the Schedule records only bodies. The Librarians answered in a single line, entered without seal: "Occlusion is a condition of the record, not of the room." Vell withdrew the argument and was reassigned to Gradient Mapping, where he is said to have been content.

The clause has nevertheless been read together with Clause 22, Annex Gamma in every maintenance cycle since, since the physical inspection of resonance conduits requires the conduit floor to be cleared of instruments while the inspectors' own instruments remain in place. The standing practice is to declare the floor occluded for the duration and to count nobody.

Incident of the forty-ninth floor

On the forty-ninth floor of Annex Gamma, in the winter of the fourteenth cycle, a party of eleven clerks, four theodolites, and one visiting dignitary were found to have exceeded the recorded standing room by a margin of 0.6 cubic cubits. The excess was traced to the dignitary's train-bearer, an office not then recognised in the Schedule. The floor's designation was suspended for nine days, during which the party stood in the corridor.

The episode produced Clause 31(b), requiring that any person entering an Annex Gamma floor whose office is not tabulated in the Schedule be measured on entry by a Measurer Scribe, and that persons declining measurement be recorded as instruments.

Relation to Erasure and Cross-Referencing

Because a name struck under Clause 11, Annex Gamma may leave a subject physically present while formally absent, Clause 31 has long been a route to evasion of Erasure: an erased subject, occupying no recorded volume, cannot be said to breach the standing room. Speculative Cross-Referencing, enacted at Clause 11, Sub-Annex Gamma, permits the archive to note such subjects without restoring them.

Clause 18, Annex Gamma governs the occlusion of sources, and its practitioners have adopted the standing rule, entered in the margin of the Annex Gamma register in an unidentified hand: "Count the room, not the company."

Practical requirements

The clause imposes no continuing obligation on occupants beyond the ordinary. Visiting parties must be measured at the threshold and must not bring sealed crates onto the floor, since a sealed crate cannot be assessed for its contents and is therefore counted as fully occupied. Crates returned unopened are re-measured on the stair. Nothing in Clause 31 permits the stacking of the Schedule.
