The Wandering Addendum Incident
MS 9085.23 · Practices and doctrines
The Wandering Addendum Incident (formally docketed under the Bureau of Legal Perambulation as matter 9-Iota/193) was a fourteen-month period during which provisions of Tower law were found to be in force at floors where they were not filed, and absent from folios where they were. It is the founding event of the modern doctrine of jurisdictional drift and the direct occasion of Addendum 12 of the Second Concordance, the Addendum Proviso, and the office of witness to the silence. No document was lost. This is the point on which every subsequent inquiry has foundered.
Chronology
The incident is conventionally dated from 14 Eleventh to 23 Eleventh of Cycle 193. On the first date, a copyist ascending to the Western Legal Stacks reported that the folio customarily holding Addendum 9 to Concordance Iota was present, sealed, and empty. The addendum was at that moment being applied in three pending reconciliations on floors 44, 812, and 1,006, and its absence from Spiral 207 was entered in the day-book as a clerical error and struck through. See Incident of the Wandering Addendum.
Over the following weeks the addendum's text — the ''Regulations for the Containment of Anticipated Echoes'' — was reported in seven locations, none of them sequential and none of them its designated folio. Witnesses on floor 44 described reading it in a stairwell; a keeper at Spiral 207 recorded it as audible but not visible for the better part of an afternoon. On 17 Eleventh the Office of Folio Integrity issued its first finding: the addendum was legally effective throughout and physically absent from its place. Both statements were held to be true, and the office declined to reconcile them.
The addendum returned to its folio on 23 Eleventh. It has not moved since. The Seventh Concordance, Addendum 7-G records the return with the single marginal note, "restored; no cause found," which remains the fullest official account of the phenomenon's cessation.
The wandering lemma
The incident's legislative afterlife is chiefly owed to The Wandering Lemma, set out in Addendum 12 of the Second Concordance. The Lemma holds that a provision's authority derives from its enrolment and not its whereabouts, and that the physical situation of a document is a matter for the Office of Folio Integrity rather than for the courts. It was drafted in eleven days and has been litigated for the better part of a century.
"A rule does not cease to bind because it has gone for a walk; and a rule that has gone for a walk may not be cited where it has not been enrolled, however plainly it is seen."
— Second Concordance, Addendum 12, clause 3
The clause's two halves are the source of nearly all subsequent difficulty. The first settled the question of effectiveness during the original incident. The second created a class of text that may be read but not pleaded, and it is not agreed whether the drafters intended this or discovered it afterwards.
Disputed readings
The Third Concordance takes a narrower view. In its Annex 4 the Lemma is characterised as a description of a single episode "of no precedential weight beyond the four walls of Spiral 207," a phrase the Bureau of Legal Perambulation has twice been asked to strike and twice declined to strike. The Bureau's reasoning, recorded in its annual return for Cycle 344, is that the phrase is itself enrolled and therefore binding somewhere, and that striking it would raise exactly the question the Lemma was written to avoid.
A third position, advanced by the Recensionists of the Lower Annexes and never adopted, holds that the incident has been misdated. On their account the fourteen months of Cycle 193 are a later gloss on an earlier disturbance in Cycle 781, when a migrating addendum concerning the same regulations was recorded across seven non-sequential floors. The Recensionists observe that both accounts describe seven floors and a document about anticipated echoes, and conclude that the archive has preserved one event twice in different centuries. The Bureau has examined the claim on three occasions and each time found the documents distinct, chiefly on the ground that the Cycle 193 addendum was numbered and the Cycle 781 addendum was not.
Legislative consequences
The Addendum Proviso to Concordance 308 was drafted directly in response to the incident and remains its most consequential legacy. The Proviso requires that any provision found to be absent from its folio be described in the record as "elsewhere effective," a formulation intended to prevent courts from treating absence as repeal. It was used four times in its first decade and seven hundred and eleven times in its most recent, a rise the Bureau attributes to improved reporting and the Recensionists attribute to the Proviso itself.
The office of witness to the silence was created in the same session. Its holder attends any reading of a document that cannot be produced and attests that the reading occurred. The office has been held without interruption since Cycle 193 and has never been called upon in a contested matter, though the present holder, Clerk Amarine Vest, has attended forty-one readings and records that the silences have all been short.
Aftermath and reprisal
The Reconciliation of the Wandering Stacks, completed in Cycle 194, audited every folio in the Western Legal Stacks against its enrolment and found one discrepancy: an addendum counted twice in the index and once in the stacks. The discrepancy has been left in place as a control.
Comparative work at the Wandering Gallery and in the Wandering Stairwell of Floor Ξ-777 has since established that the incident was not unique and may not have been first. Both are treated as separate holdings; see Incident of the Wandering Gallery and Incident of the Wandering Resonance. The Wandering Index of Floor 1,114-Δ lists every known migration and is itself missing.
Maintenance of the affected folio is now carried out on the eleventh of each month, and the folio is not to be dusted twice.
