The Controversy of the Empty Niche
MS 2223.59 · Events and incidents
The Controversy of the Empty Niche was the collective designation given to the administrative, metaphysical and procedural disputes that followed the recovery of an undocumented physical object — a marble, of ordinary glass, 14 mm in diameter — from Floor 899-A during the winter survey of Spiral 899. The controversy ran from the survey's filing in the second week of that winter until the promulgation of Clause 412 of the Seventh Concordance, and it is generally credited with the decline of the Transcendentalist faction and with the formalization of the Thorne Niche as a standard architectural element. It is the earliest controversy in the archive in which the floor number of the disputed locus is not itself in dispute.
Origin on Floor 899-A
Floor 899-A was at the time of the survey an Empty Floor in the technical sense established by The Problem of Empty Floors: a floor carrying a number, no name, no fittings and no assigned body of catalogued material. The survey team, led by Arrin of the Empty Pockets, Senior Librarian, was tasked only with confirming that the floor remained empty. It did not.
The marble was found at the north-east corner, resting on bare stone, and was recorded in the survey ledger under the entry "one (1) object, glass, spherical, green, undocumented." Arrin's initial petition to the Office of Vacant Registries did not dispute the object's existence. It disputed the office's competence to receive it. "We have found a thing where the registry says there is nothing," Arrin wrote, "and the registry has no column for a thing found where there is nothing," (Petition 899-A/4, Arrin of the Empty Pockets). The petition was returned unread on the grounds that it had been sealed in the wrong wax.
The empty-niche question
The controversy's name derives from the solution first proposed by the structuralist delegation: that the marble be placed in a niche constructed for it, and that the niche then be catalogued as empty. On this reasoning the floor would resume its status as an Empty Floor, the registry would require no amendment, and no precedent concerning objects found on vacant floors need be established. The proposal was debated at length in what became known as the Grey Niche debates, convened at the Grey Niche in Aperture Omega, Lower Scriptoria, Niche 47-Ξ, where the taxonomic principle governing such recesses was eventually set down.
Opponents objected that a niche containing a marble is not empty, whatever the catalogue says, and that the Tower would be asserting a vacancy it could see to be false. The structuralists replied that the catalogue is the vacancy, and that the eye has no standing. The exchange is preserved in the disputation minutes and is quoted in nearly every subsequent treatment of the question:
"If the niche is empty, the marble is not in it. If the marble is in it, the niche is not empty. We are asked to choose which of these two sentences the Tower would prefer to be true."

The Thorne Niche and Clause 412
A recess built to the structuralist specification was duly installed on Floor 899-A and fitted with a plaque recording its contents as nil. Within a season the plaque had been amended twice by different offices and once, informally, by a cleaner. The arrangement satisfied no one, and the dispute widened until it reached the Concordance Assembly, which resolved it by formalizing the recess itself rather than the practice of emptying it. The resulting fixture, the Thorne Niche, is a specially constructed recess for housing "Thorne Objects" found on Empty Floors, with a standardized design specified in Annex 4 of the Seventh Concordance. The plaque specification is fixed, and the fixing is not decorative: annexes to the same Concordance record that a Thorne Niche plaque is to be read from the left, and that plaques removed for cleaning must be returned to their own niche and not to a neighbouring one.
Clause 412 also established the precedent for which the controversy is chiefly cited in later proceedings: that work product derived from an improperly sanctioned source is invalid, and that the invalidity attaches to the work rather than to the source. Under this clause, the original survey ledger of Floor 899-A was struck from the register, though the marble it recorded was not.
Scholarly disagreement
The Concordances disagree about what Clause 412 actually decided. The Seventh Concordance states plainly that the Thorne Niche was created to house objects of the kind found on Floor 899-A, and that no further question remains open. The Eleventh Concordance, drafted some decades later, refers in its preamble to "the unresolved matter of the Niche at 899," and its Annex 2 lists the marble among materials whose provenance is "held in suspension." Neither document has been withdrawn. The Office of Vacant Registries continues to cite the Seventh; the Bureau of Suspended Provenance, a body created by the Eleventh, cites the Eleventh; and a joint circular of the two offices, issued in an attempt at reconciliation, cites both in the same sentence, which the Office of Doctrinal Review has noted without comment.
Structuralist writers, meanwhile, deny that the controversy established anything about objects at all, and cite the collapse of the Transcendentalist position as a consequence of methods akin to seed-weaving — that is, of procedures that produce a result only by first assuming the result. The Transcendentalists did not accept this characterisation in their own lifetime and have not been in a position to contest it since the faction's decline.
Aftermath
The marble remains in the Thorne Niche on Floor 899-A, where it is inventoried annually. The inventory is conducted by two clerks, one from each of the offices named above, who are required to attend together and to sign the same sheet. They have not always agreed on what they saw. The sheet is filed regardless.
Arrin of the Empty Pockets submitted four further petitions after Clause 412, none of which concerned the marble. All four were accepted. The Correspondents of the Empty Shelf cite the controversy as the origin of their practice of corresponding about holdings they cannot visit, and the Regency of the Empty Chair treats the survey of Floor 899-A as its founding precedent, though the Regency's own records do not support this and the claim has never been pressed.
