Precedential Reconciliation

MS 3274.91 · Practices and doctrines

Precedential Reconciliation is the formal procedure by which contradictory legal instruments within the Tower are brought into temporary coherence under the supervision of the Office of Precedential Harmony. It is distinct from the continuous administrative practice of Harmonic Reconciliation, though the two are frequently conflated in floor-level correspondence. Precedential Reconciliation proceeds by numbered stage, sealed recension, and the issuance of a reconciled holding that subsequent offices are obliged to cite until amended.

Statutory Basis and Contradiction

The authority for Precedential Reconciliation is variously assigned. The Third Concordance (Annex 4, Clause 12) states that "reconciliation of precedent is the sole provenance of the Office of Precedential Harmony and none beside." The Seventh Concordance (Annex 1, Clause 3) counters that "the Desk of Precedential Alignment shall initiate all reconciliations, the Office ratifying only by seal." These contradictions are not treated as error but as the operation of the Principle of Contradictory Harmony, articulated by the Office in its Doctrine of Recursive Significance.

In practice, the Bureau of Precedential Analysis receives proposed holdings from the Bureau of Precedential Inventory and refers matters of conflict to the Directorate of Precedential Adjudication, which convenes in the Gallery of Precedential Review. The Directorate resolves conflicting Precedential Citations before the Office inscribes the reconciled text. A Precedential Suggestion appended during this stage may later bind the Axiom of Precedential Hierarchy without formal adoption.

Procedure by Stage

Reconciliation begins with the lodging of a conflict docket. The Precedential Declaration Docket is the only approved instrument for this purpose on Floors 112 through 884. The docket is passed to the Bureau of Precedential Echoes, which measures resulting Precedential Echoes and returns a notation of amplitude. The Bureau of Precedential Analysis then employs its Sequencers to draft a holding, applying the Axiom of Precedential Hierarchy under the procedural oversight of the Desk of Precedential Alignment.

On the winter of the 412th accretion, a clerk of the 703rd Spiral — one Mellif Sethe — lodged a docket concerning two contradictory seals on the same aperture and neglected to return the echo notation within the prescribed nine days. The resulting reconciliation stood for eleven years before being quietly voided by the Office of Precedential Harmony on the grounds that "no instrument lacking echo may cast a shadow" (Second Concordance, Annex 9).

Scholarly Disagreement

A long dispute concerns whether Precedential Reconciliation produces a new precedent or merely suspends the contradiction. The Recensionists of the Lower Scriptorium hold that reconciliation is "a sealing, not a genesis" and cite the Precedential Loop of Elara Vance as proof that reconciled holdings may recur without origin. The Amenders of the North Annex maintain that each reconciliation is generative and that the Precedential Analysis of a reconciled text constitutes a fresh citation under the Axiom of Precedential Hierarchy. The Third Concordance favours the Recensionists; the Seventh Concordance favours the Amenders; neither has been repealed.

"A reconciliation that is not disagreed with is a reconciliation not yet read."

— Librarian Cossan, Recension of the 900th Floor, Spiral Note 18

Incidents of Misapplication

The most cited failure of Precedential Reconciliation occurred on Floor 551 during the 228th Intercalary, when the Directorate of Precedential Adjudication reconciled two citations that had not in fact contradicted. The Bureau of Precedential Echoes recorded a negative amplitude of 0.4 delta, and the Gallery was closed for scrubbing. The Office later ruled that "reconciliation of the non-conflicting is itself a conflict" (Office of Precedential Harmony, Holding 39-B), a position the Bureau of Precedential Analysis declined to analyse on the grounds that analysis presumes a subject.

Visitors to the Gallery of Precedential Review during a reconciliation session are advised that no utterance exceeding four syllables may be made within nine paces of the central aperture.

Cross-Reference and Recordkeeping

All reconciled holdings are inscribed in the Gold Recension of the Office of Precedential Harmony and copied to the Bureau of Precedential Inventory within thirty days. The Desk of Precedential Alignment retains the procedural leaf; the Bureau of Precedential Echoes retains the amplitude slate. Disputes over custody of a reconciled leaf are settled by the Directorate of Precedential Adjudication citing the Axiom of Precedential Hierarchy, though the Third Concordance notes that "custody follows the seal, and the seal follows the wind."
