Precedent Curation
MS 0037.54 · Practices and doctrines
Precedent Curation is a procedural doctrine governing the classification, maintenance, and authorized citation of legal precedent within the administrative and judicial systems of The Tower. It is distinct from, though often conflated with, the Judicial Precedent Guild's role in precedent authentication. The doctrine is codified in Annex 7 of the Twelfth Concordance and is administered by the Bureau of Precedential Integrity on Floor 2̸4̸7̸, "The Verdict."
Core Principles
The foundational axiom of Precedent Curation is that a precedent, once formally entered into the Tower's records, acquires a reality independent of the case that spawned it. This is articulated in The Axiom of Precedent Reality, which states: "The curated precedent is the only precedent." Consequently, the factual details of the original dispute are archived separately and are considered irrelevant for future citation; only the curated textual formulation holds legal weight. This separation is enforced by the Doctrine of Textual Immutability, which forbids the amendment of a curated precedent's wording, though its applicability may be re-evaluated.
The Curation Process
Curation occurs in three distinct phases:
- Provisional Registration: Following a ruling from the Court of Unseen Precedents or a similar judicial body, the precedent text is submitted to the Bureau with a full dossier of contextual arguments. It is assigned a provisional designation (e.g., P-Δ/12).
- Collation and Concordance Check: Bureau clerks cross-reference the provisional text against all active Concordance articles and existing curated precedents, such as Precedent Ω-7/45, to identify conflicts, overlaps, or silent repeals. This phase often involves formal petitions from the Auditors of Precedent.
- Final Inscription and Shelving: The approved, immutable text is inscribed on vellum treated with stilled light protocols to prevent spectral decay. It is then physically shelved in the Hall of Administrative Precedent and its citation code is published in the Circular of Precedent.
The entire process, from provisional registration to final shelving, is mandated to take no less than forty-five days and no more than one hundred and twenty, as per Curation Standard 45.
Categories of Curated Precedent
Precedents are categorized not by subject matter, but by their perceived durability and scope of influence:
- Cardinal Precedents
- Considered foundational to a branch of Tower law. Alteration requires a full convocation of the Judicial Precedent Guild and an amendment to a primary Concordance. Examples include the precedents governing the Doctrine of Predictive Quarantine.
- Administrative Precedents
- Govern internal procedures, resource allocation, and inter-departmental disputes. Most precedents cited in daily operations fall into this category. Their curation is overseen directly by the Bureau.
- Provisional Precedents
- Precedents issued under emergency authority or those pertaining to subjects under active predictive quarantine (see School of Predictive Curation). They carry an automatic sunset clause and must be re-curated every five years.
- Negated Precedents
- Precedents that have been formally superseded (e.g., Precedent Omega7 12 by Precedent Omega745) but are retained in a separate annex for historical and cautionary reference. Citing a negated precedent without also citing its superseding instrument is a Class-3 citation violation.
Controversies and Disputes
The most persistent scholarly debate concerns the "drift" between a precedent's original context and its curated form. The School of Particulars argues that curation sanitizes precedent, stripping it of the nuanced particularities that gave it moral weight, thereby creating a "government of phrases." Proponents of curation, primarily within the Bureau, counter that this very abstraction is what allows for consistent, equitable application across the Tower's infinite and varied floors.
A more practical dispute involves the Citation of Opposing Precedent. While the curation process seeks to resolve conflicts, contradictory precedents can and do coexist in the archive, leading to so-called "precedent storms" where litigants barrage adjudicators with mutually invalidating citations. Resolution typically requires a ruling from the Court of Unseen Precedents, which may result in the curation of a new, overriding precedent.
Relation to Other Doctrines
Precedent Curation interfaces closely with the School of Predictive Curation, particularly regarding precedents that involve events which have not yet (or have failed to) materialize. Such precedents are handled under special protocols outlined in Concordance 11. Furthermore, the Calibration of measurement and standards across floors relies entirely on a curated set of metrological precedents maintained by the Bureau's Metrology Division.
