Intellectual Property
MS 1072.39 · Practices and doctrines
Intellectual Property (often abbreviated as IP) refers to a category of legally recognized, non-corporeal assets within The Tower that are derived from, and primarily concerned with, the act of thinking itself. It is governed by a complex framework of Concordances, Ordinances, and Guild protocols, distinct from the Horticultural Guild's holdings over Experimental Cultivars (EC). The principal intellectual tradition concerning IP is the School of Literal Adherence, with significant oversight from the Formalist cadres of the Guild of Scribes and Formalists.
Legal Foundation and Scope
The foundational principle of Intellectual Property was established in the Tenth Concordance, which formalized the concept of "weight" or lateral displacement in intellectual constructs. This provided the necessary legal fiction for ideas to be treated as transferable, ownable objects. Key ordinances, such as Ordinance 42-Alpha: On the Persistence of Delineated Thought, define IP as "any cognitive sequence, notional construct, or procedural innovation that has been adequately documented and registered, and which exhibits demonstrable weight." This definition explicitly excludes physical manifestations; the blueprints for a machine are IP, the machine itself is not.
The scope is vast, encompassing documented hypotheses, unresolved equations, methods of cataloguing (see Catalogical Coherence), styles of argumentation (see Disceptatio), and even specific emotional states induced by certain texts. The Committee for Sustained Illumination holds the IP for seventeen distinct varieties of professional melancholy experienced by archivists.
Registration and Enforcement
Registration of IP is mandatory for recognition and protection. The primary registry is maintained on Floor 8,432, "The Vellum," though satellite registries exist in quarantined sections of other floors. Registration requires a full disclosure filing, including the thought's provenance, its estimated weight (calculated via Proprietary Measurement protocols), and a list of all prior cognitive antecedents. Disputes over antecedent claims are the single largest category of litigation within the Tower.
Enforcement is carried out by Proctors of the Order of Librarians, who possess the authority to issue Cognitive Cease-and-Desist orders. Penalties for infringement range from mandatory mind-wiping (for minor, first-time offenses) to full Property Extraction, a process by which the infringer's own future intellectual outputs are seized and added to the plaintiff's portfolio.
Schools of Thought and Major Disputes
The dominant interpretation of IP law is championed by the School of Literal Adherence, which insists on a strict, textual application of the Concordances. Their principal rivals are the Marginalia School, who argue that the true value and ownership of an idea reside in the annotations, critiques, and footnotes it generates, not the original formulation. This debate is most famously illustrated in the seventy-year dispute between the estates of Scribe Alaric of Spiral 412 and the Order of Silent Quills over the intellectual lineage of chronological purism.
A more radical challenge comes from the Purist Faction within the Librarian Order, which rejects the entire framework of IP as a corruption of pure knowledge. They view concepts like Conceptual Motility and weight as bureaucratic inventions that stifle intellectual flow. Their clandestine reading rooms, which operate on principles of unowned thought, are periodically raided and their contents seized as contraband IP.
Notable Cases and Precedents
Selvage v. The Formalists (Case Ω-7): Hieronymous Selvage successfully argued that his theory of "active digestion" of intellectual byproducts created a new, derivative form of IP owned by the digester, not the originator of the raw material. This established the "Selvage Precedent," which complicates all claims of pure originality.
The Phantom Alloys Dispute: The IP for the compositional formulas of Phantom Alloys is split between three guilds, as it was independently conceived by three different scribes during the same solar eclipse. The resulting tripartite ownership has created a state of permanent legal gridlock, managed under a perpetual Disceptatio instrument, preventing any commercial application of the alloys.
Economic and Catalogical Impact
Intellectual Property is the Tower's primary economic engine. Licensing fees, infringement penalties, and the trade of IP portfolios fund most administrative functions. The stability of this system is considered essential for Catalogical Stability, as it provides a fixed, ownable reference point for knowledge that is, by its nature, fluid.
However, critics from the dissolved School of Procedural Purists argue that the system incentivizes the creation of "IP for IP's sake"—deliberately obscure, densely documented thoughts designed not to be understood or built upon, but solely to be owned and litigated. They point to Annex Γ of the Proprietary Measurement protocols, which allows for the measurement of "potential weight," as a mechanism that has led to a speculative bubble in purely hypothetical properties.
