Implied Waivers

MS 4020.91 · Practices and doctrines

Definition and standing

Implied Waivers are a class of dispensation recognised within the Tower's administrative canon by which a requirement, prohibition, or procedural obligation is treated as having been suspended without any instrument having been issued to that effect. Unlike the Structural Integrity Waiver granted by the Department of Structural Integrity, or the transit waivers produced by the Office of Vertical Logistics, an Implied Waiver leaves no seal, bears no signature, and is entered into no register. Its authority is derived entirely from the absence of a record requiring that it exist. The classification is currently enumerated as Provisionary Class-M, though three separate recensions of the Fifth Concordance assign it three different letters. The Chronologers' Guild has declined to date any instance of an Implied Waiver, holding that a dispensation with no issuance cannot possess a commencement.

Origins

The doctrine is generally traced to a dispute raised before the Panel on Implied Preconditions concerning cargo that had already passed through a restricted aperture on floor 2,116. The forwarding clerk could produce no waiver, and no record existed of one having been applied for. The Panel's ruling, preserved in the twelfth annex to the Protocols of Interdependence, held that the absence of an objection at the time of passage constituted the dispensation itself.

"Where no contrary instrument is extant, the proceeding is understood to have been permitted."

— Protocols of Interdependence, Annex 12

This reasoning was extended by degrees. The School of Implied Prohibition has argued strenuously that the clause was intended to cover only cargo measurements and never personnel, a reading that the Department of Implied Texts characterises as "untenable on the face of the document" in its marginal note to the same annex.

Relation to Implied authority

The relationship between Implied Waivers and the broader field of implication remains contested. Lysander the Implied, whose existence is posited by the central doctrines of the School of Implied Prohibition, is frequently invoked as the authority under whose general dispensation particular waivers operate. On this reading, an individual Implied Waiver is merely an instance of Lysander's standing non-presence, and to request one in writing is a category error. The counter-position, associated with Conjectural Mapping and its practitioners, holds that Implied Waivers are administrative in nature and entirely separable from questions of ontological implication. Under this view the waiver has no author at all, only a recipient, and the machinery of Project Gift and the Great Taxonomy of Implied Fauna has no bearing on its validity. The Committee for Ontological Review has issued emergency transit waivers that suspend provisions of the Seventeenth Concordance, Clause VII; whether such emergency instruments are distinct from Implied Waivers, or are in fact the only legitimate species of them, is the subject of an unresolved dispute first tabled in the winter of the Long Cataloguing.

Notable instances

The most frequently cited instance concerns the passage of a freight lift through floors whose numbering is not sequential in any way anyone has been able to reconstruct, at a moment when no coordinating clearance could be located. The lift was later found to have stopped twice, unloaded, and continued upward. No clerk accepted responsibility, and no minutes record the unloading. The event is entered in the Register under the heading "permittable," a term that appears nowhere else in the Tower's vocabulary. A second instance, less frequently invoked but of greater administrative consequence, involves a corridor on floor 88 whose closure had been ordered and never effected. The corridor remains open. The order remains on file. Both are cited, in the same document, as evidence for the same proposition.

Standing objections

The Vorn Criterion is routinely offered against Implied Waivers on the grounds that a dispensation which cannot be produced cannot be scrutinised, and that a requirement which has never been identified cannot be said to have been waived. Proponents respond that this is precisely the condition the waiver describes. Visitors are reminded that the west annex stairwell is unlit between the hours when it is most frequently used, and that no waiver, implied or otherwise, has been issued for its traversal.
